Իրավաբաններն ու լրագրողները համախմբվել են Ադրբեջանի հանցագործությունները միջազգային ատյաններում ներկայացնելու գործում

Հայաստանյան մի խումբ փաստաբաններ, իրավաբաններ, իրավապաշտպաններ և լրագրողներ ստեղծել են նախաձեռնություն, որի նպատակն է կազմակերպել ադրբեջանական զինված խմբավորումների կատարած հանցագործությունների հետևանքով տուժած զոհերի իրավահաջորդների և տուժողների պաշտպանությունը միջազգային ատյաններում:

Լրագրողների հետ հանդիպմանը փաստաբան Նիկոլայ Բաղդասարյանը նշեց, որ ճանապարհը բաց է, պարզապես, պետք է համախմբվել և համատեղ գործել:

«Այս գործընթացը քաղաքականից բացի պետք է ունենա նաև իրավական ճանապարհ:  Մենք տեսնում ենք, որ իրականում կա բաց: Քաղաքացիական հասարակութունն այն չափով չի ներգրավված, որը մենք կցանկանայինք: Տվյալ բացը լրացնելու համար որոշեցինք ստեղծել այս նախաձեռնությունը, որին շատ արագ միացան լրագրողներ, իրավաբաններ»,-ասաց Նիկոլայ Բաղդասարյանը:  

«Մեդիա և իրավունք » ՀԿ նախագահ Լիլիթ Լալայանը նշեց, որ լրագրողներն իրականացնելու են  փաստահավաք գործունեությունը,  իսկ իրավաբաններն էլ կգնան դատական գործընթացը կազմակերպելու ուղղությամբ:

«Փաստահավաք գործունեությունն իրականացվում է: Կապի մեջ ենք բոլոր այն լրագրողների հետ, ովքեր այդ օրերին աշխատել են առաջնագծում: Եղած փաստերը տարբեր են` ականատեսների վկայություններ, տեսանյութեր, լուսանկարներ և այլն: Աշխատում ենք նաև այն միջազգային լրատվամիջոցների հետ, որոնք նույնպես այդ օրերին եղել են Արցախում: Խնդրել ենք մեզ տրամադրել ոչ միայն հրապարակված, այլև չօգտագործված «հում» նյութերը»,-ասաց Լիլիթ Լալայանը:

Նիկոլայ Բաղդասարյանի խոսքով, միջազգային տարբեր ատյաններ դիմելու հնարավորությունները շատ են: Խնդիր է դրված չսահմանափակվել միայն մեկ ատյանով: Խոսելով եղած գործիքներից, Նիկոլայ Բաղադասարյանը նախ ներկայացրեց Մարդու իրավունքների եվրոպական դատարանի հնարավորությունները: Նրա  փոխանցմամբ` այստեղ դիմողը լինում է զոհը, այն անձը, ով տուժել է տվյալ իրավիճակից: Եվրոպական դատարանում պատասխանողը պետությունն է: Կա նաև Միջազգային քրեական դատարան դիմելու հնարավորություն: Նրա տեղեկացմամբ, քանի որ Հայաստանը չի վավերացրել համապատասխան փաստաթղթեր ը, հետևաբար, այս դեպքում Միջազգային քրեական դատարան կարող է դիմել ՄԱԿ-ի ԱԽ-ն, ինչպես նաև տվյալ դատարանի կազմում գտնվող դատախազը:

«Քրեական միջազգային դատարանը բոլորովին այլ տրամաբանությամբ է գործում, պատասխանատվության է ենթարկում ոչ թե պետությանը, այլ քաղաքացիներին:  Շատ է խոսվում այն մասին, որ Արցախը  չճանաչված պետություն է, արդյոք Քրեական միջազգային դատարան դիմելու հարցում խնդիր չի՞ լինի: Կարող եմ ասել, որ կա նախադեպ` Սուդանի դեպքը, այն ևս ՄԱԿ-ի անդամ չէր, բայց դատարանում գործին ընթացք  էր տրվել»,-ասաց Նիկոլայ Բաղդասարյանը: Նա ընդգծեց, որ կա ճանապարհ, և պետք է համատեղ ջանքերով առաջ գնալ: Նիկոլայ Բաղդասարյանը տեղեկացրեց, որ ԱՄՆ-ի ճանաչված իրավաբաններ ից մեկն իր պատրաստակամությունն է հայտնել անշահախնդիր աջակցել և հետամուտ լինել հարցին:
