ՔԿԾ-ն պարզաբանում է, թե ինչու Եգորյանին չի թույլատրվել տեսակցել Գասպարիին

Քրեակատարողական ծառայությունը պարզաբանում է ներկայացրել ԶԼՄ-ներում տարածված այն տեղեկատվության վերաբերյալ, թե Վարդգես Գասպարիի պաշտպան Տիգրան Եգորյանին թույլ չեն տվել հանդիպել իր վստահորդի հետ:

Այդ կապակցությամբ քրեակատարողական ծառայությունը պարզաբանում է, որ փետրվարի 25-ին ժամը 14:17-ին Տիգրան Եգորյանը դիմում է ներկայացրել ՀՀ ԱՆ «Նուբարաշեն» ՔԿՀ` հայտնելով, որ ինքը Գասպարիի պաշտպանն է եւ խնդրել է թույլատրել տեսակցել վերջինիս:

Սակայն Գասպարիի անձնական գործի ուսումնասիրությունից պարզվել է, որ այնտեղ բացակայում է վարույթն իրականացնող մարմնի կողմից ձերբակալվածներին կամ կալանավորվածներին պահելու վայրի վարչակազմին ուղղված համապատասխան հավաստագիր` առ այն, որ փաստաբան Տիգրան Եգորյանը Վ.Գասպարիի պաշտպանն է: Ավելին` առկա է Երեւանի Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարանի դատավոր Ն. Խաչատրյանի թիվ 40/18-31154 գրությունը, համաձայն որի՝ կալանավորված անձ Վ.Գասպարիի պաշտպանը Դավիթ Գյուրջյանն է:

Գասպարիի պաշտպանությունը ստանձնելու վերաբերյալ օրենսդրությամբ սահմանված հիմքեր կցված չեն եղել նաեւ փաստաբան Եգորյանի կողմից ներկայացված դիմումին:

Համաձայն «Ձերբակալված եւ կալանավորված անձանց պահելու մասին» ՀՀ օրենքի 15-րդ հոդվածի՝ ձերբակալված կամ կալանավորված անձի տեսակցությունը փաստաբանի կամ պաշտպանի հետ տրամադրվում է այն դեպքում, երբ փաստաբանը կամ պաշտպանը ներկայացնում է անձը հաստատող փաստաթուղթ եւ փաստաբանական գործունեության արտոնագիր կամ փաստաբանի վկայական՝ քրեական վարույթն իրականացնող մարմնի կողմից ձերբակալվածներին կամ կալանավորվածներին պահելու վայրի վարչակազմին ուղղված համապատասխան հավաստագրի հիման վրա։

Ինչ վերաբերվում է քրեական գործի հետ չկապված` որպես փաստաբան, իրավաբանական օգնություն ցույց տալու հանգամանքին, ապա ըստ քրեակատարողական ծառայության տարածած հաղորդագրության` հիշյալ ընթացակարգը եւս հստակ կանոնակարգված է «Ձերբակալված եւ կալանավորված անձանց պահելու մասին» ՀՀ օրենքի 15-րդ հոդվածով, ըստ որի՝ կալանավորված անձի միջնորդության հիման վրա քրեական վարույթն իրականացնող մարմնի որոշմամբ` նրան թույլատրվում են նաեւ առանձին, անարգել տեսակցություններ քրեական գործով պաշտպան չհանդիսացող փաստաբանի հետ, եթե դա կապված է կալանավորված անձին քրեական գործի քննության հետ չկապված իրավաբանական օգնություն ցույց տալու անհրաժեշտության հետ։ Սույն դեպքում ՔԿԾ-ն օրենքով սահմանված վերոհիշյալ հիմքեր չի գտել:

Արդեն նույն օրը ժամը 17:15 -ին «Նուբարաշեն» ՔԿՀ է ներկայացվել Հատուկ քննչական ծառայության թիվ 18-170-կգ-16 գրությունը, ըստ որի՝ Տիգրան Եգորյանը Հատուկ քննչական ծառայությունում քննվող մեկ այլ քրեական գործով Գասպարիի պաշտպանն է: Նոր դրանից հետո հեռախոսակապի միջոցով Տիգրան Եգորյանը տեղեկացվել է, որ իրավունք ունի անխոչընդոտ այցելել «Նուբարաշեն» ՔԿ հիմնարկ եւ տեսակցել իր վստահորդի հետ:
