ArmLur.am-ը տեղեկացավ, որ հանրային քննարկման է դրվել «Հայաստանի Հանրապետության աշխատանքային օրենսգրքում լրացումներ և փոփոխություն կատարելու մասին» օրենքի նախագիծը։

E-draft հարթակից ArmLur.am-ը տեղեկացավ, որ նախագծի քննարկման ժամկետը սահմանված է 01.04.2026-ից մինչև 17.04.2026։

Ուսումնասիրությունը ցույց տվեց, որ նախաձեռնության նպատակն է ապահովել աշխատողների աշխատանքի և ընտանեկան պարտականությունների արդյունավետ համատեղումը, ինչպես նաև ներդնել աշխատանքի կազմակերպման ժամանակակից գործիքներ։

Մասնավորապես, նախագծով առաջարկվում է օրենսդրորեն սահմանել «ծնողական ժամ» եզրույթը՝ մինչև 12 տարեկան երեխա ունեցող աշխատողների համար։ Ըստ առաջարկի՝ աշխատող ծնողը կկարողանա օգտվել այդ ժամից՝ երեխային նախադպրոցական կամ դպրոցական հաստատություն ուղեկցելու կամ այնտեղից վերցնելու նպատակով։

Նախագծով նախատեսվում է, որ մինչև երկու երեխա ունեցող ծնողներին կտրվի օրական առավելագույնը 30 րոպե, իսկ երեք և ավելի երեխա ունեցողներին՝ մինչև մեկ ժամ «ծնողական ժամ»։ Այն տրամադրվելու է աշխատողի գրավոր դիմումի հիման վրա։

Բացի այդ, ArmLur.am-ը տեղեկացավ, որ առաջարկվում է նաև օրենսդրորեն ամրագրել ճկուն աշխատանքային գրաֆիկի կիրառման հնարավորությունը։ Այս դեպքում աշխատանքի սկիզբն ու ավարտը կարող են որոշվել աշխատողի և գործատուի փոխադարձ գրավոր համաձայնությամբ՝ պահպանելով աշխատաժամանակի ընդհանուր նորմերը։

Ուսումնասիրությունը ցույց տվեց, որ ներկայում գործող օրենսդրությամբ նման կարգավորումներ հստակ սահմանված չեն, ինչի հետևանքով գործնականում հաճախ առաջանում են խնդիրներ՝ հատկապես փոքր երեխաներ ունեցող աշխատողների համար։

Նախագիծը մշակվել է ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության կողմից, և, ըստ հիմնավորման, դրա ընդունումը չի պահանջում լրացուցիչ ֆինանսական միջոցներ և չի հանգեցնի պետական բյուջեի ծախսերի կամ եկամուտների փոփոխության։

Նախաձեռնության ընդունման դեպքում ակնկալվում է աշխատողների սոցիալական պաշտպանության բարձրացում, աշխատանքի և ընտանեկան կյանքի հավասարակշռության բարելավում, ինչպես նաև աշխատավայրերում հնարավոր վեճերի նվազում։
