Առավոտյան, արդեն, ահազանգող գրություններ եմ ուղարկել ԵԽԽՎ Գլխավոր քարտուղարին, Նախարարների կոմիտեին, ՄԻԵԴ նախագահին, ինչպես նաև ԵԽ Մարդու իրավունքների տնօրինությանը և ՀՀ-ում հավատարմագրված բոլոր դեսպաններին ՝ տեղեկացնելով, որ Նիկոլ Փաշինյանի կառուցած ժողովրդավարական Հայաստանում Էդգար Ղազարյանի խոսքի իրավունքը դատական որոշմամբ սահմանափակվել է։ Եվ դա արվել է Ղազարյանի քաղաքական-քննադատական խոսքերի համար, ինչը նշանակում է, որ նա քաղհալածյալ է։

Գրության մեջ մասնավորեցրել եմ՝ Էդգար Ղազարյանը մասնագիտորեն վերլուծել է ՍԴ 2024թ սեպտեմբերի 26-ին կայացրած վճիռը` Սահմանազատման կանոնակարգը Հայաստանի սահմանադրությանը համապատասխանող ճանաչելու վերաբերյալ, ներկայացրել, որ ՀՀ ազգային շահերին ուղղակի վնաս է հասցվել և սա միայն Էդգար Ղազարյանի կարծիքը չէ, շատ գործիչներ են այս մասին բարձրաձայնել: Բայց ՍԴ-ին, դատավորներին հեղինակազրկելու հիմքով վարչական հսկողություն է սահմանել դատարանը միայն Էդգար Ղազարյանի մասով` սահմանափակելով նրա քննադատության, խոսքի ազատության իրավունքը դատավորների, քննիչների, դատախազների, հարկադիր կատարողների և նրանց մերձավոր ազգականների վերաբերյալ: Ու այս ամենը եղել է ՄԻԵԴ դատավոր Վահե Գրիգորյանի դիմումի հիման վրա։

Տեղի ունեցածը խոսքի ազատության ուղղակի սահմանափակում է, որը ՀՀ Սահմանադրությամբ և միջազգային կոնվենցիաներով ամենապաշտպանված, հիմնարար իրավունքներից է:

Գրության մեջ հիշեցրել էի 2025թ փետրվարի 14-ին Մյունխենի անվտանգության համաժողովի ընթացքում հնչեցրած ԱՄՆ փոխնախագահ Ջեյ Դի Վենսի խիստ կարևոր հայտարարությունը` խոսքի ազատության մասով, մեջբերում եմ.

«Ամերիկայում դուք չեք կարող ստանալ ժողովրդավարական մանդատ, եթե գրաքննության ենթարկեք ձեր ընդդիմախոսներին կամ նրանց բանտարկեք՝ լինի դա ընդդիմության առաջնորդը, իր սեփական տանն աղոթող համեստ քրիստոնյա, թե լրագրող, ով պարզապես փորձում է լուսաբանել իրադարձությունները։ Դուք չեք կարող ստանալ ժողովրդավարական մանդատ, եթե անտեսեք ձեր հիմնական ընտրազանգվածի կարծիքը՝ այնպիսի հարցերում, ինչպիսին է՝ ով կարող է լինել մեր ընդհանուր հասարակության անդամ…»:
Հաշվի առնելով ԱՄՆ փոխնախագահի տված բանաձևը ժողովրդավարության և խոսքի ազատության պատկերացումների վերաբերյալ, ակնկալում եմ, որ գոնե Էդգար Ղազարյանի աղաղակող փաստի առիթով միջազգային հանրությունը կհայտնի իր դիրքորոշումը՝ համապատասխան քայլերով` թույլ չտալու խոսքի ազատության սահմանափակում:

Ի վերջո պետք է հասկանանալ որքանով է ժողովրդավարության, խոսքի ազատության չափանիշների մեջ տեղավորվում Էդգար Ղազարյանի նկատմամբ դատարանի վճռով հաստատված վարչական հսկողությունը, որը ուղիղ նշանակում է խոսելու, քննադատելու արգելք` մի շարք պաշտոնյաների նկատմամբ:
