Ներքին գործերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2008 թ. փետրվարի 7-ի N 134-Ն որոշման մեջ: Նախագծի ընդունման արդյունքում կացության կարգավիճակ ստանալու համար նախատեսված փաստաթղթերը ներկայացնելու, քննարկելու ընթացակարգերի հետ կապված հարաբերություններում լիազոր մարմին կսահմանվի ՆԳՆ Միգրացիայի և քաղաքացիության ծառայությունը: Այն ՆԳՆ-ին ենթակա մարմին է, որի կազմում օրենքի ուժով ընդգրկվել է նաև Ոստիկանության անձնագրային և վիզաների վարչությունը։ N 134-Ն որոշման մեջ կատարվող փոփոխությունների համաձայն՝ վարչությանը վերապահված գործառույթները կսահմանվեն որպես Միգրացիայի և քաղաքացիության ծառայության գործառույթներ։

Պրակտիկայում առաջ են եկել խնդիրներ, որոնք նախատեսվում է կանոնակարգել այս նախագծով: Օրինակ՝ օտարերկրացուն կացության կարգավիճակ կամ կացության քարտ տրամադրելու համար վերջինս պետք է ներկայացնի վավեր անձնագիր, քանի որ կացության քարտում ներառվում է նաև տեղեկատվություն անձնագրի սերիայի և համարի վերաբերյալ։ Գործնականում լինում են դեպքեր, երբ մինչ օտարերկրացուն կացության կարգավիճակ տրամադրելու վարույթի ավարտը լրանում է անձնագրի վավերականության ժամկետը։ Օտարերկրացիներին կացության կարգավիճակ տրամադրելու համար նախատեսված տեղեկատվական համակարգերը ծրագրված են այնպես, որ դրանց միջոցով որևէ գործողություն հնարավոր է իրականացնել անձը հաստատող բացառապես վավեր փաստաթղթի կիրառմամբ:

Նախագծով սահմանվել է վավեր անձնագրի հիման վրա կացության քարտ տալու անմիջական կարգավորում։ Պրակտիկայում շատ են դեպքերը, երբ հիմնավոր կասկած է առաջանում դիմումատուների՝ ՀՀ քաղաքացի հանդիսանալու մասով, օրինակ՝ դիմումատուն հրաժարվում է ներկայացնել իր ծննդյան վկայականը, ծնողների ամուսնության փաստը և նրանց անձը հաստատող փաստաթղթերի պատճենները՝ նշելով, որ օրենսդրությամբ նման պարտավորություն չունի։ Արդյունքում կարող են լինել դեպքեր, երբ օրենքի ուժով ՀՀ քաղաքացիություն ձեռք բերած անձին, որպես օտարերկրացի, տրվի կացության կարգավիճակ, քանի որ նշված փաստաթղթերը չներկայացնելու փաստով պայմանավորված հնարավոր չի եղել պարզել վերջինիս ՀՀ քաղաքացի հանդիսանալու հանգամանքը։

Որոշման մեջ նախատեսվում է լրացում, որով վարչական մարմնին իրավունք է վերապահվում այն դեպքերում, երբ առկա չեն բավարար ապացույցներ անձի ՀՀ քաղաքացի հանդիսանալը բացառելու և նրան որպես օտարերկրացի համապատասխան կարգավիճակ տալու համար, պահանջել համապատասխան փաստաթղթեր։
