ՄԻՊ-ի մասին օրենքը կփոխվի. կառավարությունը դեմ չէ

«Մարդու իրավունքների պաշտպանի մասին» սահմանադրական օրենքում փոփոխություններ կարվեն։ Նախագծի հեղինակը ԱԺ մարդու իրավունքների պաշտպանության հանձնաժողովի նախագահ Թագուհի Թովմասյանն է։ Կառավարությունը դեմ չէ առաջարկված փոփոխությանը։
Գործադրի այսօրվա նիստում հավանության արժանացած նախագծով մասնավորապես առաջարկվում է Մարդու իրավունքների պաշտպանի ընտրության համար նախատեսված մեկամսյա ժամկետը փոխարինել եռամսյա ժամկետով:
Որպես նախագծի հիմնավորում արդարադատության նախարարությունը նշել է, որ նախատեսված փոփոխությունը պայմանավորված է «Հայաստանի Հանրապետության Ազգային ժողովի կանոնակարգ» սահմանադրական օրենքի 145-րդ հոդվածով և Հայաստանի Հանրապետության Սահմանադրության 138-րդ հոդվածով՝ Մարդու իրավունքների պաշտպանի ընտրության համար նախատեսված եռամսյա ժամկետով:
Մասնավորապես առաջարկվում է փոխել «Մարդու իրավունքների պաշտպանի մասին» օրենքի 13-րդ հոդվածի 5-րդ մասը, որով նախատեսվում է, որ «պաշտպանի լիազորությունները դադարելու դեպքում, բացառությամբ ժամկետն ավարտվելու հիմքով պաշտպանի լիազորությունների դադարման դեպքի, պաշտպանի ընտրությունն անցկացվում է հաղորդագրության հրապարակման օրվանից հետո՝ մեկ ամսվա ընթացքում»: Նոր իրավակարգավորմամբ առաջարկվում է սահմանել 3-ամսյա ժամկետ։
Կառավարության հավանությանն արժանացած օրենքի նախագիծն առաջիկայում կներկայացվի խորհրդարանի քննարկմանը և ընդունվելու դեպքում ուժի մեջ կմտնի հրապարակմանը հաջորդող օրվանից։
Հիշեցնենք` ՀՀ ՄԻՊ Քրիստինե Գրիգորյանն այդ պաշտոնից ազատվել էր 2023թ–ի հունվարի 23-ին` 1 տարի պաշտոնավարելուց հետո։
Մարտի 28-ին «Քաղաքացիական պայմանագիր» խմբակցությունը պաշտոնապես Մարդու իրավունքների պաշտպանի պաշտոնում առաջադրել է Անահիտ Մանասյանի թեկնածությունը:
Ընդդիմադիր «Պատիվ ունեմ» և «Հայաստան» խմբակցություններն օմբուդսմենի թափուր պաշտոնում առաջադրել են Էդգար Ղազարյանի թեկնածությունը։
