Պետական եկամուտների կոմիտեն առաջարկում է փոփոխություններ կատարել կառավարության 2020 թ.-ի դեկտեմբերի 3-ի N1976-Ն որոշման մեջ: Նշվում է, որ նախագծի ընդունման նպատակը հարկային վարչարարության արդյունավետության բարձրացումը և ՀՀ հարկային օրենսգրքով կիրառվող հասկացությունների ճիշտ կիրառման ապահովումն է: Մասնավորաբար, առաջարկվում է ՀԴՄ կտրոնի վրա ապրանքի անվանման և ապրանքային դիրքի, աշխատանքի կամ ծառայության անվանման և կոդի, ինչպես նաև գնվող ապրանքի քանակի և դրա չափման միավորի (բացառությամբ «կանխավճար» գրառում ունեցող կտրոնների) տպագրման պահանջ սահմանել այն հարկ վճարողների համար, որոնց նախորդ տարվա (2022 թ.-ից սկսած) իրացման շրջանառությունը գերազանցել է 24 մլն դրամը։

Նախագծով առաջարկվում է նաև որոշման մեջ համապատասխան փոփոխություն կատարելու միջոցով որոշման կարգավորումները համապատասխանեցնել օրենսգրքի փոփոխված դրույթներին, այն է՝ սահմանել, որ հանրային սննդի ծառայությունների մատուցման դեպքում ՀԴՄ կտրոնի վրա նաև փաստացի մատուցվող ծառայության շրջանակներում տրամադրվող ճաշացուցակը (կերակրատեսակների, խոհարարական արտադրատեսակների, խմորեղենի և հացաբուլկեղենի և գնովի այլ ապրանքների անվանումները), ինչպես նաև գնվող ապրանքի քանակը և դրա չափման միավորը (բացառությամբ «կանխավճար» գրառում ունեցող կտրոնների) տպագրվում է նախորդ տարվա արդյունքներով 24 մլն դրամ և ավելի իրացման շրջանառություն ունեցող հարկ վճարողների կողմից:

Նախագծի հիմնավորման մեջ ասվում է, որ կառավարության N1976-Ն որոշման N3 հավելվածի 16-րդ կետի համաձայն՝ ՀԴՄ կտրոնի վրա ՀՀ հարկային օրենսգրքով սահմանված ապրանքի անվանումը և ապրանքային դիրքը, աշխատանքի կամ ծառայության անվանումը և կոդը, ինչպես նաև գնվող ապրանքի քանակը և դրա չափման միավորը (բացառությամբ «կանխավճար» գրառում ունեցող կտրոնների) տպագրվում են նախորդ տարվա (2013 թ.-ից սկսած) արդյունքներով 58.35 մլն դրամ և ավելի իրացումից հասույթ ունեցող հարկ վճարողների կողմից։ Խնդիրն այն է, որ վաճառվող ապրանքի անվանումը և ապրանքային դիրքը, աշխատանքի կամ ծառայության անվանումը և կոդը, ինչպես նաև գնվող ապրանքի քանակը և դրա չափման միավորը ՀԴՄ կտրոնի վրա չտպագրելը հնարավորություն չի տալիս նույնականացնել վաճառվող ապրանքների կամ մատուցվող ծառայությունների և դրանց վերաբերյալ հարկային մարմին ներկայացվող անհրաժեշտ տվյալները, ինչը ռիսկի գնահատման տեսանկյունից բարդացնում և անարդյունավետ է դարձնում հարկային վարչարարության իրականացումը։

Միաժամանակ, 2022 թ.-ի ապրիլի 12-ին ընդունված «Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» ՀՕ-103-Ն օրենքով սահմանվել է, որ հանրային սննդի ծառայությունների մատուցման դեպքում հսկիչ դրամարկղային մեքենայի կտրոնի վրա պետք է տպագրված լինի նաև փաստացի մատուցվող ծառայության շրջանակներում տրամադրվող ճաշացուցակը (կերակրատեսակների, խոհարարական արտադրատեսակների, խմորեղենի և հացաբուլկեղենի և գնովի այլ ապրանքների անվանումները)՝ Կառավարության սահմանած կարգին և ժամկետներին համապատասխան։

Որոշումն ուժի մեջ է մտնում 2023 թ.-ի հուլիսի 1-ից և տարածվում է նախորդ տարվա (2022 թվականից սկսած) արդյունքներով 24 մլն դրամ և ավելի իրացման շրջանառություն ունեցող հարկ վճարողների նկատմամբ։ Նախագիծը E-draft-ում հրապարակվել է նոյեմբերի 15-ին, բայց արդեն իսկ ունի դիտումների բավականին մեծ քանակ, ինչպես նաև դեմ քվեարկողներ: Եթե դիտարկենք վերջին շրջանում հրապարակված նախագծերը, ապա սա առանձնանում է իր հանդեպ ձեռք բերած հետաքրքրությամբ և, կարծես թե, բացասական տրամադրվածությամբ:
