Հարգելի՛ քաղաքապետ Տարոն Մարգարյան:
Շնորհակալություն եմ հայտնում մեզ՝ ուսուցիչներիս մատուցած հերթական «հաճելի» անակնկալի համար, այն է՝ հունվարի 3-10-ը ներառյալ՝ առավոտյան 11:00-ից մինչև 15:00-ը, դպրոցում հերթապահություն սահմանելը:
Նախ՝ Դուք տեղյա՞կ եք այդ շրջաբերականից, որն ուղարկվել է դպրոցի տնօրեններին: Եթե այո, ապա ո՞րն է հերթապահության իմաստը, երբ դպրոցում աշակերտ չկա, ողջ հանրապետությունը հանգստանում է, իսկ աշխատանքային օրերը վերսկսվելու են հունվարի 11-ից: Եթե տեղյակ չեք, ապա ո՞ւմ «պայծառ» ուղեղում է նման «փայլուն» միտք ծագել:
Պարո՛ն քաղաքապետ, Աշխատանքային օրենսգրքի 156-րդ հոդվածի 1-ին կետը հստակ սահմանում է ոչ աշխատանքային օրերը՝ տոնական և հիշատակի օրերը: Նույն հոդվածի 2-րդ կետը սահմանում է հետևյալը. «Ոչ աշխատանքային` տոնական և հիշատակի օրերին արգելվում է աշխատողներին ներգրավել աշխատանքում, բացառությամբ այն աշխատանքների, որոնց դադարեցումն արտադրության տեխնիկական պատճառներով անհնար է, կամ որոնք անհրաժեշտ են բնակչության սպասարկման, ինչպես նաև անհետաձգելի նորոգման և բեռնման կամ բեռնաթափման աշխատանքների կատարման համար»:
Նույն օրենսգրքի 185-րդ հոդվածն ասում է. «1. Հանգստյան և սույն օրենսգրքի 156-րդ հոդվածի 1-ին մասով նախատեսված օրերին կատարված աշխատանքը, եթե դա նախատեսված չէ աշխատանքի ժամանակացույցով, վճարվում է ժամային (օրական) դրույքաչափի կամ գործավարձի կրկնակի չափից ոչ պակաս չափով, կամ աշխատողի ցանկությամբ նրան մեկ ամսվա ընթացքում տրամադրվում է այլ հանգստյան օր, կամ այդ օրն ավելացվում է ամենամյա արձակուրդին:
2. Աշխատանքի ժամանակացույցով հանգստյան օրը կատարված աշխատանքը վճարվում է ժամային (օրական) դրույքաչափի կամ գործավարձի կրկնակի չափով»:
Հարգելի՛ քաղաքապետ, ինչպես գիտեք, դպրոցներն աշխատում են հնգօրյա աշխատանքային գրաֆիկով, հանգստանում են շաբաթ-կիրակի: Բացատրեք, խնդրեմ, հունվարի 9-ին և 10-ին (շաբաթ-կիրակի) հերթապահելու իմաստը: Եթե այս ամենն իր տրամաբանական բացատրությունը չունենա, ինձ մնում է միայն տրված հրամանի հեղինակին դիմել մեծն Թումանյանի խոսքերով. «Ակու՜նք իմաստության»:
