VIDEOՈրեւէ տեղ նշված չէ, որ երկրի վարչապետը, առավել եւս Արդարադատության նախարարը Սահմանադրությունը մեկնաբանելու իրավունք ունեն եւ որոշել, թե ինչը պետք է կիրառել, ինչը՝ ոչ: Այս մասին ՍԴ-ի մոտ լրագրողների հետ զրույցում նշեց «Իրավական ուղի» ՀԿ համահիմնադիր Ռուբեն Մելիքյանը:
Նա հայտարարեց, որ այսօր արդեն իսկապես ունենք սահմանադրական դատարանի ճգնաժամ. «Այն, ինչի մասին մեկ տարի խոսում էին, նրանք իրենց ձեռքով ստեղծեցին»:
Մելիքյանի խոսքով, մոտեցումներից մեկի համաձայն 2-3 դատավորներ այլեւս դատավոր չեն, մյուսի համաձայն՝ նրանք շարունակում են իրենց պաշտոնավարումը՝ այն պարզ պատճառով, որ ՍԴ-ի մասին սահմանադրական օրենքը փնթի գտնվելու պատճառով ժամանակին չեն փոխել. «Մոտեցում կա, որ այս փաստաթուղթն ընդհանրապես իրավական ուժ չունի, կա նաեւ մոտեցում, որ ունի, սակայն կիրառելի չէ: Սա արդեն ճգնաժամ է նշանակում: Մենք այսօր ունենք փշուր-փշուր եղած սահմանադրական կարգ եւ շատ դժվար է լինելու մեր հանրությանը վերականգնել այս խայտառակ վիճակը:
Եթե անգամ համարում ենք, որ սահմանադրական փոփոխությունները թղթի կտոր չեն, այստեղ մենք գործ ունենք դրա կիրառելիության հետ, որովհետեւ ունենք ՍԴ-ի մասին օրենք, որտեղ կա այն կանոնը, որը մեզ ծանոթ է»,-ասաց նա՝ հավելելով, որ սահմանադրական փոփոխությունների ուժի մեջ մտնելու վերաբերյալ արդարադատության նախարարի տեսակետը հավասար է ցանկացած ՀՀ քաղաքացու տեսակետին, ոչ մի առավելություն չունի:
Ռուբեն Մելիքյանը հայտարարեց, որ տեղի ունեցածը սահմանադրական կարգի տապալման գործընթաց է. «Այո, ես համարում եմ, որ սա սահմանադրական կարգի տապալման գործընթաց է, այո համարում եմ, որ այն, ինչ տեղի է ունեցել սկսած 2019 թվականի հունիսի 20-ից մինչեւ այսօր, սահմանադրական կարգի տապալման գործընթաց է բազմաթիվ արարներով եւ այս վերջին արարը, որը ամենակոպիտն էր, ամենաերեւացողն եր: Մենք տեսանք, որ ՀՀ վարչապետը իրեն վերապահում է օրենքներ մեկնաբանելու իրավունք եւ ի լուր աշխարհի ֆեյսբուքի էջով հայտարարում է, որ այս պահին սա է գործում կամ նա:
ՍԴ-ն այն ինստիտուտը եղավ, որն իր սկզբունքայնության, իր աշխատանքի շնորհիվ հնարավորություն տվեց բոլորիս հասկանալ, թե մենք ում հետ գործ ունենք: Արդյոք գործ ունենք մարդկանց հետ, որոնք իրավական արժեքներ են կարեւորում, թե գործ ունենք մարդկանց հետ, որոնք պատրաստ են իրավական արժեքները ոտնատակ տալ քաղաքական նպատակահարմարության շահից ելնելով:
Հնարավորություն տվեց հասկանալ՝ մենք ունենք պետության գլուխ ՀՀ նախագահ, թե՞ մենք ունենք մարդ, որ գիշերվա կեսին պատրաստ է լինել Արտուշ պապիկ:
Արդյոք մենք ունենք խորհրդարանական երկո՞ւ ընդդիմադիր ուժ, թե՞ մեկ ընդդիմադիր ուժ, իսկ երկրորդը «Իմ քայլը» դաշինքի մի առանձին ֆրակցիա կարելի է համարել»,-ասաց Մելիքյանը:
