Տոտալիտարիզմից` պառլամենտարիզմ

Ցանկացած ժողովրդավարական համակարգերի կատարյալ կայացման համար առաջնային դերակատորում ունի պառլամենտարիզմ ասվածը:
Բազմակուսակցական համակարգի ձևարումը ուղղակի նպաստում է որպես ժողովրդավարական խորհրդարանի կայացման գործընթացին:
Ժողովրդավարական հասարակությունում կուսակցություններն ունեն առանձնահատուկ առաքելություն` որպես քաղաքացիական հասարակության կարևորագույն օղակ և որպես իրենց կառուցվածքով բացառիկ դիրք ունեցող կառույցներ` միաժամանակյա ներկայությամբ և հասարակության մեջ, և իշխանության մեջ:
Հարկ է նշել, որ պառլամենտարիզմը պետության ժողովրդավարության և իրավական պետություն կայացման համար հիմնական ուղենիշերից մեկն է: Պետք է փաստել, որ 1995-ին ընդունված սահմանադրության հիմնական բացերից մնկն այն է, որ խորհրդարանական փոքրամասնության դերակատարումը հասցված է մինիմումի: Սահմանադրական օրենքների ինստիտուտի բացակայությունը փոքրամասնությանը զրկել է օրենսդրական քաղաքականության վրա արևէ իրական ներազդեցությունից:
Պառլամենտարիզմի մշակույթը քաղաքակիրթ երկխոսության մշակույթ է, որի արմատավորման իրավական նախադրյալները պետք է ստանան սահմանադրական ամրագրում: Հայ իրականության մեջ, սակայն, որպես կանոն արմատավորվել է քաղաքական առճակատման համակարգը, ինչը բացասաբար է անդրադառնում օրենսդիր մարմնի դերակատարության վրա և երկրի կայուն զարգացման համար լուրջ արգելք է:
Այս առումով հավելենք, որ քանզի խորհրդարանական համակարգում հիմնական քաղաքական սահմանագիը ոչ թե օրենսդիրի և գործադիրի մեջ է, այլ քաղաքական մեծամասնության և խորհրդարանական փոքրամասնության, ապա հանրաքվեի ներկայացված նախագծում փոքրամասնությանը վերապահել է իր դերին համարժեք իրավունքներ:
Սահմանադրության փոփոխությունների նախագծով սահմանված է այն օրենքների սպառիչ ցանկը, որոնք պետք է ընդունվեն որակյալ մեծամասնությամբ` ԱԺ պատգամավորևների ընդհանուր թվի ձայների առնվազն երեք հինգերորդով: Խոսքն այն օրենքների մասին է, որոնք անմիջականորեն ազդում են մարդու հիմնական իրավունքների և ազատությունների, ինչպես նաև պետական իշխանության, ինչպես նաև պետական իշխանության կազմակերպման վրա:
Առաջարկվող փոփոխություններով պառլամենտարիզմի կայացմանը նպաստող քայլերից կարելի է առանձնանցել նաև ԱԺ մարմիններում ընդդիմության ներկայացուցչություն, մասնավորապես` խորհրդարանի երեք փոխնախագահներից մեկը պետք է լինի ընդդիմության ներկայացուցիչ:
ՀՀ-ն, լինելով հետխորհրդային նախկին տոտալիտար համակարգում ընդգրկված երկիր, և խորհրդային արժեհամակարգի լիիրավ կրողը, նախատեսված փոփոխություններով էական քայլ է կատարում դեպի դասական պարլամենտարիզմի կայացմանը:
