Սահմանադրության և սահմանադրական օրենքի փոփոխությունն, առանց հանրային բանավեճի, օրակարգ բերելն ազնիվ չէ

 Սահմանադրական օրենքը պարունակում է քաղաքակրթական ուղերձ, թե ինչպիսին են մեր պետությունն ու հասարակությունը։ Հետևաբար՝ նրա փոփոխմամբ փոխվում է շատ կարևոր, էական մի բան՝ պետության-հասարակության դիմագիծը։

«Ազգային ժողովի կանոնակարգ» ՀՀ սահմանադրական օրենքը, «Հանրաքվեի մասին» ՀՀ սահմանադրական օրենքը, «Սահմանադրական դատարանի մասին» ՀՀ սահմանադրական օրենքը փոփոխելու հարցերն, ինչպես նաև ԱԺ 37 պատգամավորի ստորագրությամբ՝ Հայաստանի Հանրապետության Սահմանադրության փոփոխության նախագիծն ԱԺ արտահերթ նիստի օրակարգում են։ ԱԺ ղեկավարությունը հստակ չի ներկայացնում փաթեթային այս փոփոխությունների քաղաքական անհրաժեշտությունը, հանրությանը նետելով միայն պոպուլիստական խայծեր, հիմք տալով ենթադրությունների, իբր խնդիրը ՍԴ-ում կադրային փոփոխություններն են։ Սա, առնվազն, ազնիվ չէ հասարակության նկատմամբ, քանի որ թվարկված փոփոխությունների արդյունքում, հնարավոր է, ապրենք նոր Հայաստանում։

Սա հաշվի առնելով, Սահմանադրական օրենքների փոփոխության նախագծերը, ինչպես նաև ՀՀ Սահմանադրության փոփոխության նախագիծը նախ պետք է դրվեն հանրային քննարկման։ Նախաձեռնողները պետք է փորձեն ներկայացնել հասարակությանը (ոչ միայն խորհրդարանին), թե որոնք են փոփոխությունների քաղաքական, քաղաքակրթական պատճառները, անհրաժեշտությունը, ինչպես նաև հստակ ներկայացնեն, թե մշակութային առումով ինչ փոփոխության են ենթարկվելու պետությունն ու հասարակությունը։ Պետք է կազմակերպել հանրային բանավեճ, որին մասնակցելու հնարավորություն տրվի նաև արտախորհրդարանական ուժերին, քաղաքացիական հասարակության ներկայացուցիչներին, մտավորականներին։ Այնուհետև հարկ է անցկացնել հանրային կարծիքի հարցումներ, պարզելու համար հասարակական տրամադրությունները։ Եվ միայն այս ամենի համադրական վերլուծությունից հետո կարելի է մտցնել օրակարգ։

Եթե Սահմանադրությունն արտացոլում է հասարակական արժեքները և պատկերացումները, ապա Սահմանդրական օրենքն ու Սահմանադրության նախագիծն առանց այս շրջանն անցկացնելու օրակարգ բերելը բարոյական արդարացում չունի։ Եվ առնվազն կասկածելի է տարածված այն պնդումը, թե կառավարող կուսակցությունում չկա մեկը, որն իրավունք կամ համարձակություն ունենա շիտակ ներկայացնելու առաջարկվող արտահերթ փոփոխությունների բուն իմաստը։

Մնում է ենթադրել, որ փոփոխությունների բուն պատճառը ժողովրդից գաղտնի է պահվում, որովհետև կա անկանխատեսելի դիմադրության վտանգ։ Եթե այդ ենթադրյալ հիբրիդային դիմադրության կազմակերպիչը ներսում է, ապա որտե՞ղ է քնած ԱԱԾ-ն։ Իսկ եթե դրսից է, ապա կանգնած ենք լրջագույն սպառնալիքի առաջ։
