ԴԱՀԿ-ի շենքը մնացել է առանց հսկողության. «Փաստ»
SOCIETY«Փաստ» թերթը գրում է․
Արդարադատության նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որը վերաբերում է հարկադիր կատարումն ապահովող ծառայության վարչական շենքի պահպանությանը։
Հիմա՝ առավել մանրամասն։ Նախագծում նշվում է, որ հարկադիր կատարումն ապահովող ծառայության կամ ավելի պարզ՝ ԴԱՀԿ-ի վարչական շենքը տեղակայված է Երևանում՝ Հալաբյան 41ա հասցեում։
Ծառայության վարչական շենքում աշխատում է շուրջ 400 աշխատակից, բացի դրանից, ծառայություն են այցելում բազմաթիվ քաղաքացիներ, շենքի առաջին հարկում գործում է արագ սպասարկման գրասենյակ, որտեղ պարտապանները կատարում են վճարումներ։
Ի դեպ, նշվում է, որ օրական սպասարկվում է մոտ 250 քաղաքացի, գանձված գումարը երբեմն գերազանցում է 10 մլն ՀՀ դրամը։
Բացի դա, ՀՀ կառավարության 2004 թվականի հուլիսի 15-ի «Դատական ակտերի հարկադիր կատարումն ապահովող ծառայության կողմից օգտագործվող գնդի հրամանատարը 2019 թվականի նոյեմբերի 18-ին № 27/8-1258 գրությամբ ծառայությանը հայտնել է, որ ոստիկանությունում կառուցվածքային փոփոխությունների և արտաբյուջետային հաստիքների կրճատման պատճառով գունդը Հալաբյան 41ա շենքի պահպանությունը չի կարող իրականացնել՝ առանց այս նախագծի ընդունման:
Բացի սա, նշվում է, որ ավելի վաղ՝ 2019 թվականի հոկտեմբերի 14-ին, լրացում է կատարվել «Դատական ակտերի հարկադիր կատարման մասին» ՀՀ օրենքում, որի համաձայն «Հարկադիր կատարման ծառայության նյութական խրախուսման և համակարգի զարգացման ֆոնդում» առկա արտաբյուջետային միջոցները մուտքագրվում են պետական բյուջե՝ որպես ազատ մնացորդ:
Այսպիսով, ԴԱՀԿ-ի վարչական շենքի պահպանության համար ծախսերը չեն կարող կատարվել նախկինում գործող կարգով և պետք է արդեն իրականացվեն պետբյուջե մուտքագրվող միջոցների հաշվին:
Նախարարությունն ընդգծում է՝ նշված վարչական շենքի պահպանությունը և անվտանգությունը կարևորելով՝ նպատակահարմար է, որպեսզի Հալաբյան 41ա հասցեում տեղակայված վարչական շենքը ներառվի կառավարության 2004 թվականի ապրիլի 29-ի № 1008-Ն որոշմամբ հաստատված կառավարությանն առընթեր ոստիկանության կողմից պահպանության ենթակա պետական մարմինների շենքերի ու շինությունների ցանկում և որպես ՀՀ-ին սեփականության իրավունքով պատկանող անշարժ գույք, դրա անվտանգությունը և պահպանությունն իրականացվի համապատասխան լիազոր մարմնի կողմից:
