ՀՀ արդարադատության նախկին փոխնախարար Տիգրան Խաչիկյանը ֆեյսբուքյան իր էջում գրառում է կատարել՝ անդրադառնալով «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի նախագծին: Նա մասնավորապես նշել է, որ օրենքի նախագիծը դասական օրինակն է այն բանի, թե ինչպես կարելի է ձախողել հաստատված հակակոռուպցիոն ռազմավարությունը: Գրառումն ամբողջությամբ՝ ստորև.

 

««Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի նախագիծը դասական օրինակն է այն բանի, թե ինչպես կարելի է ձախողել հաստատված հակակոռուպցիոն ռազմավարությունը: Գույքի ուսումնասիրություն սկսելու խիստ անորոշ, հայեցողական այդ թվում` կոռուպցիոն ռիսկեր գեներացնող հիմքերը և բազմաթիվ այլ խնդրահարույց կարգավորումներ հիմք են տալիս վստահաբար պնդելու, որ այս օրենքի նախագիծն այս տեսքով ակնհայտ ձախողված է և սպառնալիք է երկրի իրավական անվտանգությանը:
Ստորև պարզապես մի քանի աննախադեպ փաստեր հիշյալ ձախողված օրենքի նախագծից.

 

1. Հայց հարուցելու հիմքերի ուսումնասիրության ողջ գործընթացը (որը, որպես կանոն, կարող է տևել մինչ երկու տարի) կատարյալ անվերահսկելի է, և ըստ էության, վեր է ածված քաղաքացիական տիրույթում իրացվող փաստացի քրեական մեղադրանքի առանց պատասխանողին տրվող որևէ գործնական երաշխիքի, ներառյալ` ուսումնասիրություն նախաձեռնելու մասին որոշման բողոքարկման: Հանրային և մասնավոր շահերի հավասարակշռման տեսանկյունից անթույլատրելի է նշված վարույթն իր իրավական բնույթով հավասարեցնել փաստաբանի կողմից հայցի նախապատրաստման գործընթացին, ի թիվս այլնի, մի ակնհայտ պատճառաբանությամբ, որ այստեղ գործում է գույքի` ապօրինի ծագում ունենալու կանխավարկածը, և իրավասու մարմնի կատարյալ անգործության պայմաններում անգամ գույքը կարող է բռնագանձվել:

 

2. Նախագիծը պարզապես իմաստազրկում է օպերատիվ-հետախուզական մարմինների միջոցով ապօրինի ծագում ունեցող գույքի հայտնաբերումն այնքանով, որքանով բացարձակ անհարկի նախատեսում է ներքին դիտում, նամակագրության, փոստային, հեռագրական և այլ հաղորդումների վերահսկում, հեռախոսային խոսակցությունների վերահսկում, կաշառք ստանալու կամ կաշառք տալու նմանակում միջոցառումների իրականացման արգելք:

 

3. Նշված վարույթի շրջանակներում գույքի արժեքը գնահատող փորձագետը ենթակա չէ որևէ պատասխանատվության իր կողմից կեղծ եզրակացություն տալու համար:

 

4. Ենթադրյալ ապօրինի ծագում ունեցող գույքը առանց եզրափակիչ դատական ակտի կարող է դեռևս դատական քննության փուլում օտարվել իրավասու մարմնի խնդրանքով դատարանի որոշմամբ:

 

5. Ապօրինի ծագում ունեցող գույքը` որպես նվիրատվություն ստացած անձը երբեք չի կարող բարեխիղճ լինել և գույքը վերջինիցս բոլոր դեպքերում պետք է բռնագանձվի:

 

6. Պետք է բռնագանձվի նաև որպես ալիմենտ, կյանքին և առողջությանը պատճառված վնասի հատուցում կամ որպես բարեգործություն ձեռքբերված գույքը, բացառությամբ այն դեպքի, երբ ձեռքբերողը չի իմացել և չէր կարող իմանալ դրա ապօրինի ծագման մասին:
Առաջարկում եմ ձևավորել հեղինակավոր սահմանադրագետներից ու դատավարագետներից կազմված աշխատանքային խումբ հիշյալ նախագծի իրական լրաշմակման աշխատանքները որակյալ ապահովելու համար»:
