Փետրվարի 4-ին կայանալու է «Նորաշենի նախկին համայնքապետն ընդդեմ Գարիկ Սարգսյանի» դատական նիստը

2020 թվականի փետրվարի 4-ին Վարչական դատարանում կայանալու է «Նորաշենի նախկին համայնքապետն ընդդեմ Գարիկ Սարգսյանի» գործով դատական առաջին նիստը։ Այս մասին NEWS.am-ի հետ զրույցում ասաց Արարատի մարզի Նորաշեն համայնքի նախկին համայնքապետ Նորայր Գրիգորյանը։
Նախկին համայնքապետն ասաց, որ իր պաշտպան Ամրամ Մակինյանը կրկին դիմել է դատարան՝ պահանջով, որ Արարատի մարզպետի լիազորությունները դադարեցվեն, եւ մարզպետը նախկին համայնքապետին պաշտոնից հեռացնելու որոշումը փոփոխի։
Նա նշեց, որ իր պաշտպանն այդ պահանջով դիմել էր ՀՔԾ եւ Գլխավոր դատախազություն, սակայն մերժում էր ստացել։ Նշենք, որ Արարատի մարզպետի դեմ հայցը դատարանը վարույթ է ընդունել. «Իսկ Արարատի մարզպետն ասում է՝ չի հետաքրքրում դատարանի որոշումը, ես մեկ է՝ չեմ փոխի որոշումս։ Դատարանը հայցը վարույթ է ընդունել, իսկ ՀՔԾ-ն ու դատախազությունը մերժել են, անօրինական է այդպիսի որոշումը»։
Հիշեցնենք, որ Վարչական դատարանը վարույթ է ընդունել Արարատի մարզի Նորաշեն համայնքի նախկին համայնքապետ Նորայր Գրիգորյանի հայցն ընդդեմ Նորաշեն համայնքի ավագանու եւ Արարատի մարզպետ Գարիկ Սարգսյանի։
«Վարչական դատարանում վիճարկում ենք ավագանու արձանագրությունը եւ համայնքապետի ԺՊ նշանակելու մասին մարզպետի կարգադրությունը։ Դատարանը վիճարկման հայցադիմումը ընդունել է վարույթ։ Դա նշանակում է՝ օրենքի ուժով կասեցվում է վիճարկվող վարչական ակտերը մինչեւ դատական ակտի օրինական ուժի մեջ մտնելը, այսինքն՝ կասեցվում է մարզպետի կարգադրությունը եւ ավագանու արձանագրությունը։ Առաջանում է նախկին փաստական եւ իրավական վիճակը»,–պարզաբանել էր փաստաբանը։
Հիշեցնենք, որ Արարատի մարզի Նորաշեն համայնքում բողոքի ակցիաներ են իրականացվել ընդդեմ մարզպետ Գարիկ Սարգսյանի՝ համայնքապետին լիազորություններից զրկելու որոշման առնչությամբ: Համայնքի բնակիչները դժգոհում էին, որ մարզպետը համայնքապետ Նորայր Գրիգորյանի լիազորություններն անօրինական ձեւով դադարեցրել է եւ համայնքապետ է նշանակել ավագանու անդամներից մեկին՝ Արտակ Հարությունյանին: Նորաշենցիները պահանջում էին նախկին համանքապետին վերականգնել պաշտոնում կամ նշանակել համայնքապետի տեղակալին։
Մարզպետն էլ լրագրողների հետ զրույցում հայտարարել էր, որ Նորայր Գրիգորյանը շուրջ 6 ամիս ավագանու նիստ չի հրավիրել, որն էլ հանգեցրել է իր լիազորությունները դադարեցնելուն։
