եղափոխության հիմնական հատկանիշն այն էր, որ այն հաղթանակ տարավ սահմանադրական կարգավորումների միջոցով։ Երբ Հանրապետության հրապարակում հավաքված էին տասնյակ հազարավոր մարդիկ, Նիկոլ Փաշինյանի մտքով չանցավ ինքնահռչակվել վարչապետ՝ նույնիսկ այն պարագայում, երբ մայիսի 1-ին խորհրդարանը չքվեարկեց նրա վարչապետության օգտին։

Հեղափոխությունը հաղթեց բացահայտ ճնշումների, բայց միանգամայն լեգալ գործիքների միջոցով, ինչի պատճառով նոր իշխանությոնը լեգիտիմացվեց մեր հասարակության ու միջազգային հանրության աչքերում՝ անգամ մինչև խորհրդարանական ընտրությունները։

Սակայն մեր հեղափոխությունն էլ չդիմացավ գայթակղությանն ու արդեն իշխանության կարգավիճակում տուրք տվեց սովորական զոռբայությանը ու շատերի խոսքում սովորական դարձան հակաիրավական, հակաքաղաքական եզրույթները։

Օրինակ՝ Երևանի ավագանու արտահերթ ընտրություններում բաղձալի 80 տոկոսը «նվաճվեց» «ասֆալտին պառկեցնելու» ավտորիտար ու ռեպրեսիվ, հակաիրավական ու հակաքաղաքական կարգախոսների ուղեկցությամբ։ Նույն տրամաբանությունը գործեց խորհրդարանական ընտրությունների ժամանակ, երբ պետական մակարդակով «հակահեղափոխական» կամ «սև» հռչակվեցին բոլոր այն ուժերը, որոնք նոր ընդդիմություն ձևավորելու հայտ էին ներկայացրել։ Դատական ռեֆորմի ոչ պաշտոնական մեկնարկը վերջնականապես թաղեց թավշյա հեղափոխությունը։

Անբացատրելի, անմեկնելի է այն փաստը, երբ երկրի ղեկավարը դատական ռեֆորմի դրույթները հրապարակում է՝ դատարանների մուտքերի շրջափակման հրահանգ տալով։ Այդ պարագայում՝ ռեֆորմի բովանդակությունը, գեղեցիկ ելույթները կորցնում են իրենց նշանակությունը, քաղաքական ու բարոյական էֆեկտը։

Դեռ ամիսներ առաջ հնարավոր չէր պատկերացնել, որ ՍԴ որևէ անդամ (ներողություն՝ դատավոր) կարող է ինքնիրավչությամբ իրեն հռչակել Բարձր դատարանի նախագահ։ Սա նույնիսկ աղերս չունի դատական ռեֆորմի հետ, ու ավելի ճիշտ կլինի, որ իշխանություններն ընդհանրապես հրաժարվեն ֆորմալիստական մոտեցումներից ու հայտարարեն, որ ձգտում են տոտալ իշխանության՝ թքած ունենալով բանականության ու օրենսդրության վրա։

Օրինակ՝ կարելի է առանց ֆորմալ ընթացակարգերի միանգամից նշանակել ՍԴ ու ԲԴԽ նախագահներ՝ ասելով, որ հեղափոխության առանձնահատկությունն ու տված լեգիտիմությունն օրինականացնում են նման ինքնիրավչությունը։ Սա ավելի անկեղծ ու ընկալելի մոտեցում կլինի, քան ձևականորեն ժողովրդավարությանը տուրք տալը։

Կամ՝ ի՞նչ իմաստ ունի բյուջետային միջոցներ մսխել ու խորհրդարան ու կառավարություն պահել, եթե երկրում բոլոր հարցերը որոշում է վարչապետը՝ «միակ ճշմարիտի» ու «անսխալականի» չնահանջող դիրքերից։ ՍԴ պահել նույնպես պետք չէ, որովհետև դրա ընդամենը մեկ դատավորը՝ դեռ երդում չտված ու ոտքը դատարան չդրած, հայտարարում է կառույցի ղեկավար լինելու մասին։ Հայաստանում այլևս սահմանադրական կարգավորումները չեն գործում, ու ամբողջ երկիրն ապրում է մեկ մարդու քմահաճույքով։ Այս ամենից մի տեսակ դեժավյուի հոտ է փչում. իսկ պատկերն ամբողջացնելու համար Նիկոլ Փաշինյանին մնում է մի սովորական հորդոր քաղաքացիներին՝ պարտքով ապրելու կամ յոլա գնալու մասին։
