«Դատական համակարգի նկատմամբ բավականին մեծ ճնշում կա. իշխանությունը նպաստում է դրան». Ռուբեն Մելիքյան

«Խնդիրն այն է, որ ներկայում դատական համակարգի նկատմամբ բավակաին մեծ ճնշում կա, և, ցավոք սրտի, այդ ճնշումը մեծացնելուն նպաստում է նաև այսօրվա քաղաքական իշխանությունը՝ փոխանակ ամեն կերպ նվազեցնի այդ ճնշումը և իրականացնի սահմանադրական գործառույթը՝ ապահովելու և երաշխավորելու դատական իշխանության անկախությունը և աշխատանքի բնականոն պայմանները»,- 168.am-ի հետ զրույցում ասել է Արցախի մարդու իրավունքների նախկին պաշտպան Ռուբեն Մելիքյանը:

Նա նշել է, որ այդ երաշխավորումը պատշաճ մակարդակով տեսանելի չէ․ «Իսկ ինչ վերաբերում է բարեփոխումներին, ապա ժամանակի ընթացքում բավականին արդյունավետ ձևով նախանշվել են հիմնական ուղղությունները, որտեղ պետք է դրանք իրականացվեն։ Իմ համոզմամբ՝ այդ բարեփոխումներն անբավարար արագությամբ, բայց իրականացվում էին, և ես՝ որպես Արդարադատության ակադեմիայի առաջին ռեկտոր, կարող եմ ասել, որ հատկապես այդ ժամանակահատվածում բավական ինտենսիվ էր դատական իշխանության որակի բարձրացման գործընթացը։

Ամենակարևորն այն է, որ մենք գնալով պետք է ձերբազատվենք կոնտրպրոդուկտիվ անցումային արդարադատության այս ձևակերպումից, որովհետև գործադիր իշխանությունը դեռևս չի էլ ասել, թե ինչ նկատի ունի՝ անցումային արդարադատություն ասելով։ Անցումային արդարադատությունն այսօր ընդամենն արտահայտություն է, բայց այն օրակարգ բերելն ինքնին բացասական ազդեցություն է թողնում դատական իշխանության արդյունավետության վրա։ Եվ ես այս պահի դրությամբ խնդրի լուծումն առավելապես տեսնում եմ բնականոն ռեֆորմների ճանապարհին վերադառնալու և հեղափոխական մեթոդները, մասնավորապես՝ անցումային արդարադատություն կոչվածը, որը շատերի կարծիքով արդարադատության համակարգի բնական ճանապարհով հարցերի լուծման ոչ ենթակա ճանապարհ է, բացառելու ճանապարհով»։

Հարցին, թե ո՞ւմ կողմից եք տեսնում այդ ճնշումները, Ռուբեն Մելիքյանը պատասխանել է․

«Ես առաջին հերթին խոսում էի այն ամենի մասին, ինչ տեսանելի է՝ «ժողովրդական ճնշման» մասին, և տեսնում եմ, որ գործադիր իշխանությունը, որը պարտավոր է երաշխավորել դատական իշխանության անկախությունը և գործունեության բնականոն պայմանները, ակտիվ չէ այս պարտականություններն իրականացնելու հարցում։ Կատարվում են որոշակի գործողություններ, դա երևում է, բայց ես դրանք բավարար չէի գնահատի։

Մեր քաղաքական իշխանությունը պետք է վեր կանգնի այս պահին ավելի նեղ շահերից, ու ավելի լայն և երկարաժամկետ շահերից ելնելով՝ ամեն ինչ անի մեր դատական իշխանությունն ամրացնելու ուղղությամբ։

Ի վերջո, իմ համոզմունքն այն է, որ քաղաքական իշխանությունը երկրորդական է՝ մարդու իրավունքների տեսանկյունից, առաջնայինն ամուր վստահություն վայելող արդյունավետ, ֆունկցիոնալ դատական իշխանությունն է։ Եթե մենք դա ունենանք, ապա քաղաքական իշխանությունը կարող է ցանկացած պարբերականությամբ փոխվել, ցանկացած մարդիկ կարող են լինել, մենք կիմանանք, որ մեր դատական իշխանությունը երաշխավորում է ցանկացած քաղաքացու իրավունքների պաշտպանությունը։

Վերջին շրջանը դաս է բոլորիս համար, որ որևէ դիրք, որևէ նախկին ծառայություններ հայրենիքին, պետությանը, որևէ մեկին չեն երաշխավորում՝ ապագայի տեսանկյունից, և բոլորս պետք է հասկանանք, թե՛ այսօրվա գործող իշխանությունները, թե՛ քաղաքական համակարգի մյուս խաղացողները, թե՛ մասնագիտական շրջանակները, որ վստահություն վայելող պրոֆեսիոնալ ու ֆունկցիոնալ դատական իշխանությունը բոլորիս է անհրաժեշտ»։
