ՏՄՊՊՀ-ն մերժեց «Վալլետտա» ընկերության բողոքն ընդդեմ «Բուրգեր Արմի»

«Վալլետտա» ընկերությունը դիմել է ՀՀ տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովին (ՏՄՊՊՀ),  ներկայացնելով դիմում-բողոք «Բուրգեր Արմ» ընկերության դեմ, որտեղ նշված է, որ ընկերությունը իրավասու չէ օգտագործելու «BURGER KING» ապրանքային նշանը, քանի որ այդ անունով սննդի սպասարկման կետ բացելու և համբուրգերներ պատրաստելու իրավունքը պատկանում է իրենց:

 «Արմենպրես»-ի հաղորդմամբ` «Վալլետտա» ընկերությունը Հանձնաժողովին խնդրել է արգելել վերոնշյալ ընկերության կողմից «BURGER KING» անվանման օգտագործումը՝ այն համարելով անբարեխիղճ մրցակցություն: Վերոնշյալ բողոքի հիման վրա Հանձնաժողովը հարուցել է վարչական վարույթ, որի շրջանակում կատարվել է համակողմանի ուսումնասիրություն:

 «Վալլետտա» ընկերության բողոքն ընդդեմ «Բուրգեր Արմ» ընկերության արդարացի չէ: Մեր ուսումնասիրությունները ցույց են տալիս, որ այս ճանապարհով «Վալլետտա»-ն փորձում է սահմանափակել եւ մուտքի խոչընդոտներ ստեղծել «Բուրգեր Արմ» ընկերության գործունեության համար»,-լրագրողների հետ ճեպազրույցում ասաց ՏՄՊՊՀ նախագահ Արտակ Շաբոյանը:

 «Բուրգեր Արմ» ընկերության կողմից շահագործվող «BURGER KING»-ը գործում է «Դալմա Գարդեն Մոլ» զվարճաառևտրային համալիրում և զբաղվում է արագ սննդի պատրաստմամբ և իրացմամբ: Ընկերության գործունեության ուսումնասիրությունից պարզվել է նաև, որ այն հանդիսանում է ամերիկյան «Բուրգեր Քինգ Քորփորեյշն» ընկերության հայաստանյան բացառիկ ներկայացուցիչը, որը Հայաստանում գործում է ֆրանչայզինգի պայմանագրի հիման վրա: Ի պատասխան իրենց դեմ ուղղված բողոքի, ընկերությունը Հանձնաժողովին պարզաբանել է. «Բուրգեր Քինգ Քորփորեյշն» ընկերությունը արագ սննդի բնագավառում ամբողջ աշխարհում ֆրանչայզինգի միջոցով ռեստորանային ծառայություններ մատուցող և սննդամթերք առաջարկող առաջատար ընկերություններից է, որը հանդես է գալիս «BURGER KING» ապրանքային նշանի ներքո, և սպառողներն ամբողջ աշխարհում երկար ժամանակ արդեն ճանաչում են այս բրենդը, որն առաջին անգամ օգտագործվել է 1954թ. և գրանցված է աշխարհի ավելի քան 125 երկրում»: Պատասխանի մեջ նշված է նաև, որ ամերիկյան հայտնի ընկերությունը այդ անվանմամբ գործունեություն իրականացնելու բացառիկ իրավունքը բոլոր փաստաթղթերով փոխանցել է իրենց: «Բուրգեր Արմ» ընկերության կարծիքով, բողոքող կողմն ինքն է փորձում օգտագործել սպառողին արդեն հայտնի բրենդի անվանումն ու վնաս պատճառել իրական իրավատիրոջը: «Վալլետտան» Հանձնաժողովին տեղեկացրել է, որ ունի երկու գործող սննդի կետ՝ «BURGER KING» անվանմամբ: Սակայն ՏՄՊՊՀ-ի մասնագետների կողմից կատարված դիտանցումներով պարզվել է, որ Մաշտոցի պողոտայում գործում է այլ տնտեսավարողի պատկանող միայն մեկ կրպակ, որը «Վալլետտայի» հետ կնքած պայմանագրի հիման վրա օգտագործում է «BURGER KING» նշանը: Իսկ բողոքող կողմ հանդիսացող «Վալլետտան» նման անվանմամբ սննդի սպասարկման կետ երբևիցե չի շահագործել:
