Վարչապետը հանձնարարեց ներկայացնել սնանկացման գործընթացների առողջացման առաջարկություններ

Կառավարության նիստում ՀՀ վարչապետ Կարեն Կարապետյանը հարկային պարտավորությունների կատարման ապահովմանն ուղղված սնանկության վարույթների վերաբերյալ հանձնարարական տվեց: Նրա խոսքով, իրականացված ուսումնասիրությունների արդյունքում պարզ է դարձել, որ միայն 2016-2017 թվականներին տնտեսավարողների կողմից շուրջ 22 մլրդ դրամ հարկային պարտավորությունների չկատարման հետևանքով առկա է սնանկության ավելի քան 2100 վարո ւյթ: «Չնայած որոշ տնտեսավարողների պարագայում հնարավոր է կիրառել նաև սնանկության վարույթին այլընտրանքային միջոց: Ավելին՝ սնանկության կառավարիչների գործունեությունը և արդյունավետությունը բավարար չէ, իսկ սնանկության վարույթի տևողությունը երկար է: Ստեղծված իրավիճակը պայմանավորված է թե վարչարարության կազմակերպման, թե օրենսդրության, թե սնանկության բնութագրիչների բացահայտման և այլ խնդիրներով: Խնդրահարույց է նաև այն, որ այդ ոլորտում հարկային պարտավորությունների մասով գույքի կամ դրամական միջոցների արգելադրումը կիրառվել է հայեցողաբար և ոչ համակարգված», - ասաց վարչապետը:
Հաշվի առնելով վերոնշյալը՝ Կարեն Կարապետյանը ՀՀ ԿԱ պետական եկամուտների կոմիտեի նախագահին հանձնարարեց 2-ամսյա ժամկետում ուսումնասիրել և կառավարության աշխատակազմ ներկայացնել հարկային պարտավորությունների արտադատական կարգով վարչական բռնագանձման և ծանուցման ինստիտուտի, ինչպես նաև համաչափ արգելադրման համակարգված կիրառման վերաբերյալ առաջարկություն: Միաժամանակ ներկայացնել տնտեսավարողների սնանկության հատկանիշների ճշգրիտ գնահատման և դրանք բացահայտելու ՊԵԿ գործիքակազմ:
Առաջարկությունները ներկայացնելուն պես 1-ամսյա ժամկետում կներկայացվի նաև առաջարկություն հարկային պարտավորությունների մարման ժամանակացույցի տրամադրման հայեցողական լիազորությունների սահմանափակման և կանխատեսելիության բարձրացման վերաբերյալ:
Միաժամանակ, վարչապետը ՀՀ արդարադատության նախարարի պարտականությունները ժամանակավորապես կատարողին հանձնարարեց 2-ամսյա ժամկետում ուսումնասիրել և կառավարության
Կառավարության ղեկավարի հանձնարարությամբ պետք է ուսումնասիրվեն դատական ակտերի հարկադիր ծառայության կողմից հարկադիր վարույթի տևողության և այլ գործնական, օրենսդրական խոչընդոտները և դրանք վերացնելու ուղղությամբ ներկայացվեն առաջարկություններ կառավարության աշխատակազմ:
Վարչապետը նշեց, որ սա չափազանց կարևոր աշխատանք է: «…Հետազոտությունները ցույց են տալիս, որ գործնականում սնանկացման գործընթացի մեջ ունենք առողջացման շատ քիչ օրինակներ: Ընդհանրապես դա դառնում է անկառավարելի, շատ սուբյեկտիվ գործընթաց: Այստեղ շատ կոշտ պետք է մտցնենք որոշակի համակարգ և խաղի կանոններ»,- ասաց Կարեն Կարապետյանը:
