ՀՀ գլխավոր դատախազությունը հերքել է Էդմոն Մարուքյանի հայտարարությունը

Հայաստանի Հանրապետության գլխավոր դատախազությունը հերքել է Ազգային ժողովի պատգամավոր Էդմոն Մարուքյանի հայտարարությունը Վանաձոր համայնքի ղեկավարի քվեարկության ընթացքում հիշատակված ոմն Ասրյանի վերաբերյալ: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից:
Դատախազության հայտարարության մեջ նշվում է. «ՀՀ գլխավոր դատախազությունն արձագանքելով ՀՀ ԱԺ պատգամավոր Է. Մարուքյանի կողմից ՀՀ Վանաձոր համայնքի ղեկավարի քվեարկության ընթացքում արված հայտարարությանը, թե «...Դատախազությունից մարդ է եղել այստեղ, մոտեցել է մեր կուսակցության անդամներին ու ասել՝ բաց չքվեարկեք, քրեական գործ կհարուցենք ձեզ վրա։ Հենց էստեղ տեղում են ճնշել։ Ոմն դատախազ Ասրյան էր այստեղ աշխատում... », տեղեկացնում է.
Նշված տեղեկատվությունը զուրկ է հիմնավորումներից և չի համապատասխանում իրականությանը` առնվազն այն պարզ պատճառով, որ ՀՀ Լոռու մարզի դատախազությունում Ասրյան ազգանունով (ինչպես նշել է Է. Մարուքյանը) դատախազ չի աշխատում, հետևաբար նա չէր կարող մասնակցել վերոնշյալ գործընթացին:
Դատախազի վարքագծի կանոնագիրքը հստակ սահմանում է. «...Դատախազը չի կարող լինել քաղաքական կազմակերպության անդամ, ինչպես նաև որևէ կերպ զբաղվել ակտիվ քաղաքականությամբ: Նա չպետք է հովանավորչություն դրսևորի որևէ քաղաքական կուսակցության նկատմամբ...»: Դատախազությունը հետևողական է, բոլոր աշխատակիցների կողմից սույն կանոնի խստիվ պահպանմանը:
Անընդունելի համարելով հանրության շրջանում թյուրընկալումների տեղիք տվող, չփաստարկված և վարկաբեկող տեղեկատվության տարածումը, ՀՀ գլխավոր դատախազությունը հորդորում է քաղաքացիներին, պաշտոնյաններին, առավել ևս՝ իրավաբաններին, որոնք տիրապետում են իրավական բոլոր ընթացակարգերին, զերծ մնալ չհիմնավորված և ոչ փաստարկված հայտարարություններից, որևէ դատախազի գործունեության վերաբերյալ առերևույթ իր լիազորությունները շրջանցելու հիմնավոր տվյալներ ունենալու դեպքում դրանք ներկայացնել ՀՀ գլխավոր դատախազություն՝ վստահեցնելով, որ ներկայաված տեղեկատվությունն օրենքով սահմանված կարգով քննարկման և իրավական գնահատականի կարժանանա»:
