Շվեյցարիայի ֆեդերալ տրիբունալը չեղյալ է համարել Փերինչեքի դեմ իր որոշումը

Շվեյցարիայի ֆեդերալ տրիբունալը չեղյալ է համարել թուրք ազգայնական Դողու Փերինչեքի դեմ ռասսայական խտրականություն պարունակող արտահայտությունների համար կայացված վճիռը: Ինչպես հաղորդում է «Արմենպրես»-ը` վկայակոչելով Tribune de Geneve-ը, այս մասին որոշումը դաշնային տրիբունալն ուղարկել է որոշումը կայացրած Վո (Vaud) կանտոնի (կենտրոնը` Լոզան) դատարան:
Այս մասին փաստաթղթային փաթեթն ուղարկվել է նաև Փերինչեքին:
Դողու Փերինչեքը 2005 թվականի մայիս, հուլիս և սեպտեմբեր ամիսներին Շվեյցարիայի Լոզան, Օպֆիկոն և Կոնիզ քաղաքներում կազմակերպված միջոցառումների ընթացքում հրապարակայնորեն հերքել է 1915թ. և հետագա տարիներին հայ ժողովրդի նկատմամբ Օսմանյան կայսրությունում տեղի ունեցած ցեղասպանության փաստը: Նա, մասնավորապես, հայկական ցեղասպանությունը որակել է որպես «միջազգային կեղծիք»: 2005 թվականի հուլիսին Շվեյցարիա-Հայաստան միությունը բողոք է ներկայացրել Փերինչեքի դեմ՝ վերոհիշյալ ելույթների բովանդակության կապակցությամբ:
Այդ բողոքի հիման վրա Լոզանի դատարանը 2007 թվականի մարտի 9-ին Դողու Փերինչեքին մեղավոր է ճանաչել Շվեյցարիայի քրեական օրենսգրքի՝ ռասայական խտրականության համար պատասխանատվություն նախատեսող 261bis հոդվածի 4-րդ կետով: Լոզանի դատարանն արձանագրել է, որ Փերինչեքի՝ Հայոց ցեղասպանությունը ժխտող ելույթն ունեցել է ռասիստական շարժառիթներ, կրել է ազգայնական բնույթ և չի կարող դիտարկվել պատմական բանավեճի կամ քննարկման շրջանակներում: Լոզանի դատարանը նաև նշել է, որ Հայոց ցեղասպանությունը, ըստ շվեյցարական հանրային կարծիքի, համընդհանուր ապացուցված եղլություն է, ապացուցված պատմական փաստ: Այս հիմնավորմամբ Դողու Փերինչեքը Շվեյցարիայում դատապարտվել է պայմանական ազատազրկման և տուգանքի:
Փերինչեքը Լոզանի դատարանի վճիռը բողոքարկել է շվեյցարական դատարանների տարբեր ատյաններ, սակայն արդյունքի չի հասել: Դիմելով Եվրոպական դատարան՝ Դողու Փերինչեքը պնդել է, որ շվեյցարական դատարանները, Հայոց ցեղասպանությունը ժխտելու մասին հրապարակային հայտարարությունների համար իրեն դատապարտելով, խախտել են Եվրոպական կոնվենցիայի 10-րդ հոդվածով երաշխավորված իր խոսքի ազատությունը: 2015թ. Հունվարի 28-ին ՄԻԵԴ-ի Մեծ պալատում տեղի են ունեցել «Փերինչեքն ընդդեմ Շվեյցարիայի» գործով դատական լսումները: ՀՀ գլխավոր դատախազ, ՄԻԵԴ-ում ՀՀ կառավարությ ան լիազոր ներկայացուցիչ Գևորգ Կոստանյանի գլխավորած փաստաբանական թիմի կազմում են ՀՀ արդարադատության նախարարի տեղակալ, ՄԻԵԴ-ում ՀՀ կառավարության լիազոր ներկայացուցչի տեղակալ Արման Թաթոյանը, ՀՀ գլխավոր դատախազի տեղակալ Էմիլ Բաբայանը, Լոնդոնի Doughty Street փաստաբանական պալատի հիմնադիր, միջազգային հայտնի փաստաբան Ջեֆրի Ռոբերտսոնը, միջազգային հայտնի փաստաբաններ Ամալ Քլունին և Թոբի Քոլիսը:
