Դատապարտյալին մեղադրանք է առաջադրվել քրեակատարողական հիմնարկի ծառայողին ծանր հանցագործության մեջ մեղադրելու համար

ՀՀ արդարադատության նախարարության «Հրազդան» քրեակատարողական հիմնարկի դատապարտյալ Ռուբեն Ց.-ն հաղորդում է տվել այն մասին, որ 2016 թվականի մայիսի 28-ին նույն քրեակատարողական հիմնարկի ծառայողը պահանջել է հանձնել բջջային հեռախոսը, որից ինքը հրաժարվել է՝ փորձելով այն պատուհանից դուրս նետել: Այդ պատճառով հիշյալ ծառայողը ոլորել է թևերը և բռնություն կիրառել իր նկատմամբ, ապա տ եղափոխել է պատժախուց, որտեղ շարունակել է իր նկատմամբ բռնություն կիրառել: Այս մասին«Արմենպրես»-ին տեղեկացրին Հայաստանի Հանրապետության հատուկ քննչական ծառայությունից:
ՀՀ արդարադատության նախարարության «Հրազդան» քրեակատարողական հիմնարկի պետական հատուկ ծառայություն իրականացնող անձի կողմից բռնության գործադրմամբ զուգորդված պաշտոնեական լիազորություններն անցնելու դեպքերի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 2-րդ մասի հատկանիշներով հարուցվել է քրեական գործ և կատարվել նախաքննություն:
Քրեական գործի նախաքննության ընթացքում պատշաճ ընթացակարգով ստուգվել են դատապարտյալի հաղորդման մեջ նշված դրվագների բոլոր հանգամանքները:
Նախաքննության ընթացքում իրականացված մի շարք քննչական և դատավարական գործողությունների արդյունքում հիմնավորվել է, որ դատապարտյալ Ռուբեն Ց.-ն, գիտակցելով, որ իր կողմից տրված տեղեկատվությունը կեղծ է՝ ծանր հանցագործության կատարման մեջ անհիմն մեղադրել է հիշյալ քրեակատարողական հիմնարկի ծառայողին:
Քրեական գործի նախաքննության ընթացքում ձեռք բերված ապացույցներով հերքվել է «Հրազդան» քրեակատարողական հիմնարկի աշխատակցի կողմից հանցագործություն կատարելու հանգամանքը, ուստի որոշում է կայացվել վերջինիս նկատմամբ քրեական հետապնդում չիրականացնել:
Միաժամանակ, ծանր հանցագործության մեջ մեղադրելով՝ ակնհայտ սուտ մատնություն կատարելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում հարուցված և քննվող քրեական գործի նախաքննության ընթացքում ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 2-րդ մասի 1-ին կետով մեղադրանք է առաջադրվել Ռուբեն Ց.-ին:
Քրեական գործի նախաքննությունը շարունակվում է:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
