Հանրային պաշտպանները իրականացնում են հուլիսյան դեպքերով ձերբակալված 21 անձանց պաշտպանություն

ՀՀ փաստաբանների պալատի հանրային պաշտպանի գրասենյակը հայտարարություն է տարածել հուլիսյան դեպքերի գործերով հանրային պաշտպանություն իրականացնելու վերաբերյալ։

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ փաստաբանների պալատի մամուլի ծառայությունից, հայտարարության մեջ նշված է.

«Հարգելի հայրենակիցներ,

Հուլիսյան դեպքերի հետ կապված գործերով ՀՀ փաստաբանների պալատի հանրային պաշտպանի գրասենյակ է ստացվել քրեական վարույթ իրականացնող մարմինների կողմից կայացված 46 որոշում՝ անվճար իրավաբանական օգնություն տրամադրելու վերաբերյալ: Հանրային պաշտպանի գրասենյակը ՀՀ քրեական դատավարության օրենսգրքի պահանջների համապատասխան` անհապաղ որոշումներ է կայացրել գործերը հանրային պաշտպաններին հանձնելու վերաբերյալ: ՀՊԳ-ն գործել է անազատության մեջ գտնվող անձանց անհապաղ որակյալ իրավաբանական օգնությամբ ապահովելու նպատակով:

Հանրային պաշտպանները վարույթն իրականացնող մարմինների կողմից ներկայացվել են ձերբակալված թվով 46 անձանց, սակայն, ինչպես հայտնի է, պաշտպանի իրավավիճակ կարող էին ձեռք բերել միայն ձերբակալվածների համաձայնությունը ստանալու պահից: Թվով 40 անձինք տվել են իրենց համաձայնությունը, և հանրային պաշտպանները ստանձնել են վերջիններիս պաշտպանությունը: Որևէ հանրային պաշտպան առանց տվյալ անձի համաձայնության չի ստանձնել վերջինիս պաշտպանությունը: Հանրային պաշտպանի գրասենյակում ստեղծման օրվանից ի վեր սահմանված է հերթապահություն, և հանրային պաշտպաններÕ ¨ անհրաժեշտության դեպքում աշխատել են նաև ոչ աշխատանքային օրերին և ժամերին` ըստ հերթապահության գրաֆիկի: Իսկ հուլիսյան դեպքերից հետո հանրային պաշտպանները աշխատել են արտակարգ ռեժիմով` նպատակ ունենալով ժամ առաջ հանդիպել ձերբակալվածներին, ապահովել նրանց լռելու, մարդկային վերաբերմունքի արժանանալու իրավունքի իրացումը: Հանրային պաշտպանների մասնակցությամբ գործերով 10 անձի նկատմամբ քրեական հետապնդումը դադարեցվել է, և ձերբակալված անձինք ազատ են արձակվել:

Հանրային պաշտպանները այս պահի դրությամբ շարունակում են իրականացնել 21 անձի պաշտպանություն: Հանրային պաշտպանները գործել և գործելու են իրենց երդմանը հավատարիմ` ազատ ու անկախ, անկաշկանդ ու անմնացորդ, օրենքով չարգելված բոլոր միջոցներով պաշտպանել և պաշտպանելու են իրենց վստահորդներին:

Որևէ պետական մարմին չի կարող ազդել հանրային պաշտպանների անկախությանը, միջամտել նրանց գործունեությանը: Հանրային պաշտպանի գրասենյակը հավատացնում է, որ լինելու է հետևողական, որպեսզի յուրաքանչյուր գործով առավել արդյունավետ ու որակյալ պաշտպանություն իրականացվի, իսկ առկայության դեպքում` հանրային պաշտպանի յուրաքանչյուր թերացում դառնալու է քննարկման առարկա: Հանրային պաշտպանի գրասենյակը պատրաստակամ է իրականացնել հանրային պաշտպանության կարիք ունեցող յուրաքանչյուր անձի պաշտպանությունը»:
