ՀՔԾ-ն քրեական գործեր է հարուցել ոստիկանների իրավախախտումների դեպքերով

ՀՀ հատուկ քննչական ծառայությունում ստացված մի շարք քաղաքացիների, փաստաբանների հաղորդումների, ինչպես նաև զանգվածային լրատվության միջոցներում հրապարակված տեղեկությունների քննարկմամբ տվյալներ են ձեռք բերվել այն մասին, որ մի խումբ զինված անձանց կողմից Երևանի Մ. Խորենացի փողոցում գտնվող՝ ՀՀ ոստիկանության Երևան քաղաք ի վարչության ՊՊԾ վարչական շինությունները զավթելուց հետո, 2016թ. հուլիսի 20-ից 30-ն ընկած ժամանակահատվածում, ՀՀ ոստիկանության ծառայողները, իրենց պաշտոնեական դիրքը ենթադրաբար ծառայության շահերին հակառակ օգտագործելով կամ դիտավորությամբ այնպիսի գործողություններ կատարելով, որոնք ակնհայտորեն դուրս են եկել նրանց լիազորությունների շրջանակից, Մ. Խորենացի փողոցում, հարակից տարածքներում, Սարի թաղում և այլ վայրերում հատուկ միջոցների գործադրման հետևանքով մարմնական վնասվածքներ են պատճառել տարբեր անձանց, ՀՀ ոստիկանության ստորաբաժանումներ անձանÖ բերման ենթարկելիս և դրանից հետո նրանց նկատմամբ բռնություն են գործադրել, պատճառել մարմնական վնասվածքներ, ինչպես նաև օրենքով նախատեսվածից ավելի ժամանակով ապօրինի պահել են այնտեղ՝ անձանց իրավունքներին և օրինական շահերին, հասարակության և պետության օրինական շահերին պատճառելով էական վնաս:  

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից,  ոստիկանության ծառայողները, նույն միջոցառումներն իրականացնելիս իրենց պաշտոնեական դիրքն օգտագործելով, ենթադրաբար խոչընդոտել են     լրագրողների մասնագիտական օրինական գործունեությանը և բերման ենթարկվածներին իրավաբանական օգնություն ցույց տալու նպատակով ներկայացած փաստաբանների լիազորությունների իրականացմանը: 

Հաղորդագրության մեջ նաև նշված է. «Ոստիկանության ծառայողների կողմից առերևույթ պաշտոնեական լիազորությունները չարաշահելու, բռնության և հատուկ միջոցների գործադրմամբ զուգորդված պաշտոնեական լիազորություններն անցնելու, պաշտոնեական դիրքն օգտագործելով լրագրողների մասնագիտական օրինական գործունեությանը և փաստաբանների լիազորությունների իրականացմանը խոչընդոտելու դեպքերի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով, 309-րդ հոդվածի 2-րդ մասով, 164-րդ հոդվածի 2-րդ մասով, 332.3-րդ հոդվածի 1-ին մասով հարու ցվել են քրեական գործեր, կատարվում է նախաքննություն:

Միաժամանակ, ՀՀ հատուկ քննչական ծառայությունը կոչ է անում հիշյալ դեպքերի ընթացքում տուժած քաղաքացիներին, փաստաբաններին, լրագրողներին (լրատվամիջոցներին) դիմել վարույթն իրականացնող մարմնին, առկայության դեպքում տրամադրել բռնության գործադրման, տեխնիկայի վնասման, մասնագիտական գործունեությանը խոչընդոտելու փաստերը հիմնավորող տեսաձայնագրառումները:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով

սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»:
