Քաղբանտարկյալ Վոլոդյա Ավետիսյանը բաց նամակով դիմել է Արթուր Օսիկյանին

«Վարդաշեն» ՔԿՀ-ի դատապարտյալ Վոլոդյա Ավետիսյանը վերջին երկու ամսվա ընթացքում արդեն երկրորդ անգամ է բաց նամակ հղում իրավասու պետական մարմիններին՝ պայմանական վաղաժամկետ ազատման եւ պատժի չկրած մասն ավելի մեղմ պատժատեսակով փոխարինելու հարցով:
Ինչպես տեղեկանում ենք Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակից, այս անգամ քաղբանտարկյալն իր նամակը հղել է Քրեակատարողական վարչության պետ, արդարադատության գեներալ-մայոր Արթուր Օսիկյանին:
Ստորեւ ներկայացնում ենք նամակն ամբողջությամբ.
«Հարգելի´ պարոն Օսիկյան, ս.թ. հունիսի 18-ին ես բաց նամակով դիմել էի ՀՀ Ազգային ժողովի պատգամավորների, Մարդու իրավունքների պաշտպանին եւ Արդարադատության համակարգի ղեկավարներին՝ բարձրացնելով մի շարք հարցեր, որոնք վերաբերում էին դատապարտյալների իրավունքների մասսայական ոտնահարումներին արդարադատության իրականացման ոլորտում։ Մասնավորապես, խոսքը գնում էր պատժից պայմանականորեն վաղաժամկետ ազատման եւ պատժի չկրած մասն ավելի մեղմ պատժատեսակով փոխարինելու գործընթացներին։ Իմ նամակի կապակցությամբ քրեակատարողական վարչությունից ստացել եմ գրավոր պատասխան, որտեղ պարզաբանվում է, որ բարձրացված հարցերը կարգավորվում են ՀՀ քրեական եւ քրեակատարողական օրենսգրքերի համապատասխան հոդվածներով, ՀՀ նախագահի հրամանագրերով եւ այլն: (Միայն այսքանը): Հարգելի´ պարոն Օսիկյան, ոչ միայն ես, այլեւ հազարավոր դատապարտյալներ քաջ ծանոթ ենք վերը նշված օրենսգրքերին եւ հրամանագրերին, մեզ պետք չէ նրանց մասին հիշեցնել, մեզ պետք է հստակ պատասխան, թե ինչու տարիներ շարունակ այդ օրենքները չեն գործում, կամ էլ գործում են միայն հատ ու կենտ ընտրյալների համար։ Բայց չէ՞ որ օրենքի առաջ բոլորը հավասար են (ՀՀ Սահմանադրություն)։
Դուք լավ գիտեք, որ պատիժը կրելուց պայմանական վաղաժամկետ ազատման ներկայացնելուց դատապարտյալների միայն մեկ տոկոսն է անցնում «անկախ» հանձնաժողովի թրի տակից, մնացածը բոլորովին անհասկանալի պատճառներով դուրս են մնում այդ գործընթացից: Փաստորեն հանձնաժողովի անդամները բացարձակ անվստահություն են տածում ոչ միայն դատապարտյալների, որոնցից ոչ մեկին անձամբ չեն ճանաչում, այեւ նրանց դրական բնութագրող հիմնարկության ղեկավարության նկատմամբ:
Հարգելի´ պարոն Օսիկյան, մեր խորին համոզմամբ, բարձրացված հարցերի շուտափույթ լուծումը ոչ միայն հազարավոր դատապարտյալների իրավունքների պաշտպանության հարցն է, այլեւ ողջ համակարգի պատվի խնդիրը: Հուսով ենք, որ այս կապակցությամբ ՀՀ Արդարադատության նախարարի եւ այլ պաշտոնատար անձանց խոստումները չեն մնա իրենց դարակներում որպես վերջին նշանակության երեւույթ»:
