Պերմյակովի գործով դատավորը մերժեց իր ինքնաբացարկի միջնորդ

Գյումրիում Ավետիսյանների ընտանիքի յոթ անդամների սպանության մեջ մեղադրվող Վալերի Պերմյակովի գործով դատավոր Հարություն Մովսիսյանը մերժեց իր ինքնաբացարկի միջնորդությունը՝ բավարար հիմքեր չլինելու պատճառով: Հուլիսի 12-ի Վալերի Պերմյակովի գործով հերթական դատական նիստի ընթացքում նիստը նախագահող դատավորը ընթերցեց դատավորի ինքնաբացարկի վեր աբերյալ Ավետիսյանների իրավահաջորդների շահերի պաշտպան Լուսինե Սահակյանի կողմից հուլիսի 8-ին ներկայացրած միջնորդության որոշումը: Միջնորդությանը միացել էին նաև մյուս փաստաբանները: Ինչպես որոշման մեջ նշված էր՝ տվյալ ինքնաբացարկի համար բավարար հիմքեր չկան: Հիմքերը բավարար չեն նաև ապացուցելու համար, որ դատավորը կաշկանդված է՝ ինչպես նշված էր միջնորդության մեջ:
Ի դեպ, այս դատը անցավ միայն Պերմյակովի, լրագրողների ու իրավապահ մարմինների ներկայությամբ: Դատական նիստին ներկա չէին դատապաշտպանը, դատախազը, Ավետիսյանների իրավահաջորդները և իրավահաջորդների շահերի պաշտպանները: Հաջորդ դատական նիստը նշանակվեց հուլիսի 29-ին:
Ավետիսյանների ընտանիքի 6 անդամների սպանությունը տեղի է ունեցել 2015թվականի հունվարի 12-ին՝ վաղ առավոտյան ժամը 06:00-ի սահմաններում նրանցմահը վրա է հասել հրազենային վնասվածքներից։ Ավետիսյանների ընտանիքից ողջէր մնացել 6 ամսական փոքրիկը՝ Սերյոժա Արմենի Ավետիսյանը, ով կտրող- ծակողգործիքից ստացած վնասվածքներով տեղափոխվել էր բժշկական կենտրոն, այնուհետև` յոթ օր հետո մահացել: Կասկածյալին ռուս սահմանապահները հայտնաբերել են հայ-թուրքական սահմանը հատելու փորձ կատարելիս եւ հանձնել 102-րդռուսական բազայի հրամանատարությանը:
Քրեական գործը հարուցվել է ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 1-ին կետով (երկու և ավելի անձանց սպանությունը): ՀՀ քննչական կոմիտեիքննիչները Վալերի Պերմյակովին մեղադրանք են առաջադրել ՀՀ ՔՕ 104-րդ հոդվածի 2-րդ մասի 1-ին կետով՝ երկու եւ ավելի անձանց դիտավորյալ սպանությանհամար: Վալերի Պերմյակովն ընդունել է առաջադրված մեղադրանքը:
Ռուսական կողմում հարուցված քրեական գործով Պերմյակովը դասալքության եւ զենքի ապօրինի կրման համար օգոստոսի 12-ին դատապարտվել է 10 տարվա ազատազրկման:
