Արցախի ՄԻՊ-ն այցելել է «Շուշի» քրեակատարողական հիմնարկ

Արցախի Հանրապետության մարդու իրավունքների պաշտպանը հուլիսի 11-ին չհայտարարված այցով եղել է «Շուշի» քրեակատարողական հիմնարկում` դատապարտյալների պատժի կրման պայմաններին ծանոթանալու, ինչպես նաև առանձնազրույցի ցանկություն հայտնող դատապարտյալներին հանդիպելու նպատակով:
Ռուբեն Մելիքյանը ծանոթացել է քրեակատարողական հիմնարկի ընդհանուր պայմաններին, ինչպես նաև այցելել է կիսաբաց, կիսափակ և փակ ռեժիմի բոլոր պատժախցեր` դատապարտյալներին առաջարկելով ունենալ առանձնազրույց իր կամ աշխատակազմի ներկայացուցիչների հետ: Այս մասին տեղեկացրին ԼՂՀ մարդու իրավունքների պաշտպանի աշխատակազմից:
Քրեակատարողական հիմնարկի ընդհանուր պայմաններին ծանոթանալու արդյունքում պարզվել է, որ առկա են դատապարտյալների բացօդյա զբոսանք իրականացնելու և առանձին մարզաձևերով զբաղվելու համար կահավորված տարածքներ, պատշաճ վիճակում գտնվող լոգասենյակներ, գործառնական նշանակություն ունեցող այլ ընդհանուր տարածքներ: Միևնույն ժամանակ, արձանագրվել է, որ բացակայում են արտախցային աշխատանք կատարելու ենթակառուցվածքներ:
Պատժախցեր այցելելու արդյունքում պարզվել է, որ հիգիենայի պահանջներն ընդհանուր առմամբ պահպանված են, կիսափակ և փակ ռեժիմի բոլոր պատժախցերում առկա են սարքին ռադիոընդունիչներ, իսկ կիսաբաց ռեժիմում` նաև հեռուստացույց: Միևնույն ժամանակ, կիսափակ և փակ ռեժիմի որոշ խցերում արձանագրվել են մեկ դատապարտյալին բաժին հասնող մակերեսին վերաբերող խնդիրներ:
Տասներկու դատապարտյալ առանձնազրույցի ցանկություն է հայտնել, և քրեակատարողական հիմնարկի ղեկավարության կողմից ապահովվել է մեկուսի զրույցի հնարավորություն: Բոլոր 12 դատապարտյալները լսվել են, նրանց ներկայացրած հարցերն արձանագրվել են և դրանց կապակցությամբ օրենքով սահմանված կարգով կիրականացվի ուսումնասիրություն: Առանձին դեպքերում դատապարտյալներին տրվել են իրավական պարզաբանումներ: Առանձնազրույցի ընթացքում մեկ դատապարտյալ ներկայացրել է Մարդու իրավունքների պաշտպանին ուղղված գրավոր դիմում:
Առանձնազրույցների ընթացքում պարզվել է, որ բոլոր դատապարտյալներին տրամադրվում է ամենօրյա բացօդյա զբոսանքից օգտվելու հնարավորություն, որից բոլորը պարբերաբար և ինքնուրույնաբար օգտվում են: Ոտքի հեռացում ունեցող մեկ դատապարտյալ այդ հնարավորությունից օգտվում է հենասայլակի միջոցով:
Առանձնազրույցների ընթացքում չեն ներկայացվել քրեակատարողական հիմնարկի աշխատակազմի կողմից դիտավորյալ վատ վերաբերմունք դրսևորելու, այդ թվում` ֆիզիկական ուժ կիրառելու մասին բողոքներ:
Քրեակատարողական հիմնարկի ղեկավարության հետ ձեռք է բերվել պայմանավորվածություն հիմնարկի տարածքում Մարդու իրավունքների պաշտպանին ուղղված նամակների համար առանձին փոստարկղ տեղադրելու, ինչպես նաև զբոսանքի համար նախատեսված տարածքները պտտաձողերով և անձրևից պատսպարող ծածկերով կահավորելու մասին:
Մարդու իրավունքների պաշտպանը Արցախի քրեակատարողական համակարգում մարդու իրավունքների երաշխավորման խնդիրը մշտապես պահելու է ուշադրության կենտրոնում` իր իրավասության սահմաններում նպաստելով միջազգային ինչպես պարտադիր, այնպես էլ խրախուսելի չափանիշների լիարժեք ապահովմանը: Այդ նպատակը նվաճելու համար Պաշտպանը պատրաստ է համագործակցել ինչպես քաղաքացիական հասարակության ինստիտուտների, այնպես էլ միջազգային մասնագիտացված կառույցների հետ։
