Ռոբերտ Քոչարյանի առանձնատան ուղղությամբ նռնակ նետած անձն անմեղսունակ է ճանաչվել

ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում ավարտվել է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի առանձնատան բակի մուտքի մոտ տեղի ունեցած միջադեպի առթիվ հարուցված քրեական գործի նախաքննությունը:
Նախաքննությամբ բավարար ապացույցներ են ձեռք բերվել առ այն, որ 32-ամյա Հովհաննես Մուրադյանը 2016 թվականի ապրիլի 15-ին՝ ժամը 18:25-ի սահմաններում, իր հոր անվամբ հաշվառված ավտոմեքենայով մոտեցել է ՀՀ երկրորդ նախագահ Ռոբերտ Սեդրակի Քոչարյանի առանձնատան բակի գլխավոր մուտքին և ուսումնական նռնակ նետել առանձնատան պահակակետի ուղղությամբ՝ խաթարելով ծառայություն իրականացնող պետական պահպանության աշխատակիցների աշխատանքը։
Բացի այդ, Հ.Մուրադյանի բնակարանում օրենքով սահմանված կարգով ապրիլի 18-ին կատարված խուզարկությամբ նրա անձնական իրերի մեջ հայտնաբերվել և առգրավվել է զգալի չափերի «տետրահիդրոկաննաբինոլ» տեսակի թմրամիջոց:
Ձեռք բերված ապացույցների համակցությամբ՝ ապրիլի 20-ին Հ.Մուրադյանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 258-րդ հոդվածի 1-ին մասով և 268-րդ հոդվածի 1-ին մասով:
Նախաքննության ընթացքում ՀՀ ԱՆ «Ավան հոգեկան առողջության կենտրոն» ՓԲԸ-ից ստացվել է գրություն առ այն, որ Հովհաննես Մուրադյանը 19.09.2014 թվականից հաշվառված է իրենց կենտրոնում՝ «Շիզոֆրենիա, պարանոիդ ձև» ախտորոշմամբ: Քննիչը նրա նկատմամբ նշանակել է ստացիոնար դատահոգեբուժական փորձաքննություն, որի կատարումը հանձնարարվել է ՀՀ ԱՆ «Նուբարաշեն» հոգեբուժական հիվանդանոցի ստացիոնար դատահոգեբուժական փորձաքննությունների բաժնի փորձագետներին:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, թիվ 34 եզրակացության համաձայն՝ մեղսագրվող արարքի նկատմամբ Հ.Մուրադյանին հարկ է ճանաչել անմեղսունակ. ինչպես իրավախախտումը կատարելիս, այնպես էլ ներկայումս նա չէր կարող ու չի կարող գիտակցել իր գործողությունների վտանգավորությունը, ղեկավարել դրանք։ Ներկա հոգեկան վիճակով նա չի կարող մասնակցել դատաքննչական գործողություններին, սոցիալապես վտանգավոր է ինչպես իր, այնպես էլ՝ շրջապատի համար, կարիք ունի հարկադիր բուժման՝ հատուկ հսկողության հոգեբուժական բաժանմունքի պայմաններում։
Ձեռք բերված ապացույցների համակցությամբ` քննիչը որոշում է կայացրել ՀՀ քրեական օրենսգրքով արգելված արարքները անմեղսունակության վիճակում կատարած անձի նկատմամբ բժշկական բնույթի հարկադրական միջոցներ կիրառելու համար քրեական գործն ուղարկել դատարան։
Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցվածչէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
