Նախկին ոստիկանի կողմից ծանր հանցագործություն կատարելու փաստը չի հիմնավորվել. ՀՔԾ

ՀՀ հատուկ քննչական ծառայությունը հաղորդագրություն էր տարածել, որ քաղաքացի Մահեր Մ.-ն հաղորդում էր տվել այն մասին, որ 2011 թվականին իր խանութում ոստիկանության աշխատակից Սմբատ Մովսիսյանին տվել է 2500 ԱՄՆ դոլար իր կնոջ համար ՀՀ քաղաքացու անձնագիր ձեռք բերելու նպատակով, սակայն հետագայում, հասկանալով, որ չի կարող նման ճանապարհով անձնագիր ձեռք բերել, հետ է պահանջել իր գումարը: Բացի այդ, 2012 թվականին ոստիկանության Արաբկիրի բաժնի մոտ ինքն ու Արման Սմբատյանը հանդիպել են նույն բաժնի աշխատակից Սմբատ Մովսիսյանին, որպեսզի վերջինս օգնի իր գործընկեր Արա Հ.-ի ներկայացրած բողոքի լուծման հարցում: Ս. Մովսիսյանը «հարցը լուծելու» համար իրենից պահանջել է 12 հազար ԱՄՆ դոլար, սակայն ինքը հրաժարվել է գումար տալուց:
Մահեր Մ.-ի հաղորդման հիման վրա նախապատրաստված նյութերով ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 2-րդ մասի 1.1 և 2-րդ կետով, 34-178-րդ հոդվածի 3-րդ մասի 1-ին կետով նախատեսված հանցագործությունների հատկանիշներով հարուցվել էր քրեական գործ: ՀՀ հատուկ քննչական ծառայությունում կատարված նախաքննության ընթացքում պատշաճ ընթացակարգով քննության են ենթարկվել Մահեր Մ.-ի կողմից նշված՝ ՀՀ ոստիկանության աշխատակցի կողմից ենթադրյալ հանցագործություն կատարելու դրվագների բոլոր հանգամանքները, մասնավորապես՝ քրեական գործով անհապաղ իրականացվել են անհրաժեշտ օպերատիվ-հետախուզական ու քննչական գործողություններ, կատարվել մի շարք հարցաքննություններ, կազմակերպվել առերես հարցաքննություններ:
Կատարված քննության ընթացքում բավարար ապացույցների համակցությամբ չի հիմնավորվել ոստիկանության աշխատակից Սմբատ Մովսիսյանի կողմից պաշտոնեական դիրքն օգտագործելով խոշոր չափերով խարդախություն կատարելու, առանձնապես խոշոր չափերով խարդախության փորձ կատարելու, ինչպես նաև արդարադատության կամ պետական ծառայության դեմ ուղղված որևէ այլ հանցագործություն կատարելու հանգամանքը: Նշված պայմաններում առկա ապացույցները բավարար չեն եղել նաև Մահեր Մ.-ի կողմից ակնհայտ սուտ մատնություն կատարելու՝ ՀՀ քրեական օրենսգրքի 333-րդ հոդվածով նախատեսված հան ցակազմը հաստատված համարելու առումով, ուստի որոշում է կայացվել հանցակազմի բացակայության հիմքով կարճել քրեական գործով վարույթը:
