Գերմանիայում պատերազմական հանցագործության մեղադրանքով դատական հայց է ներկայացվել Էրդողանի եւ Դավութօղլուի դեմ

 Գերմանիայում դաշնային խորհրդարանի մի խումբ պատգամավոր, իրավաբաններ, մարդու իրավունքների պաշտպաններ, լրագրողներ եւ ակադեմիկոսներ Թուրքիայի նախագահ Ռեջեփ Թայիփ Էրդողանի եւ նախկին վարչապետ Ահմեթ Դավութօղլուի նկատմամբ «պատերազմական հանցագործություն» կատարելու եւ «մարդու իրավունքները խախտելու» պնդումներով 200 էջից բաղկացած մեղադրական հայց են ներկայացրել Կարլսռուհեի Դաշնային դատախազություն:

Վկայակոչելով «Avropa Postasi» գերմանական թուրքալեզու հրատարակությունը, փաստաբան Բրիթա Էդերը եւ Պետրա Դերվիշաժը Բեռլինում կազմակերպված մամուլի ասուլիսում  հետեւյալ կերպ են մեկնաբանել Դաշնային դատախազություն ներկայացրած մեղադրականը:

«Էրդողանի եւ նրա հետ կապված լիազոր միավորների նկատմամբ դատախազություն դատական հայցը ներկայացվել է բազմաթիվ վկաների, առանձին մարդկանց, միջազգային կազմակերպությունների, քաղաքացիական կառույցների, բժիշկների, գիտնականների ցուցմունքների հիման վրա` հիմնվելով Գերմանիայի քրեական օրենսգրքի (VՓlkerstrafgesetzbuch= VStGB) համապատասխան հոդվածներին:

Հայցում ասվում է, որ Ջիզրեյում եւ Շըռնաքում անցյալ տարվա սեպտեմբերի 4-ին եւ սեպտեմբերի 11-ին ծագած բախումներում սպանվել են 21 քաղաքացիական անձինք: Ջիզրեյում երեք տարբեր նկուղներում դիտավորությամբ սպանվել են178 քաղաքացիներ: Ուժային կառույցների այդ հարձակման ժամանակ իշխանություններն արգելել են բախումների շրջան ժամանել շտապօգնության բրիգադներ, պատգամավորների, տուժածների ընտանիքների անդամներին, բջջային հեռախոսներ օգտագործել: Խոչընդոտվել է կապը Միջազգային ներման կազմակերպության  եւ քաղաքացիական կառույցների հետ: Անվտանգության ուժերը բենզին են լցրել նկուղների մուտքերի եւ ելքերին, հրդեհել, ծանր զենքեր են կիրառել եւ այրել սպանվածների դիակները», -փաստվում է հայցում:

Գերմանիայի կանաչների կուսակցության նախկին պատգամավոր եւ իրավաբան Մեմեթ Քըլըչը հայցի իրավական չափը մեկնաբանել է հետեւյալ կերպ.

«Քաղաքական անձեռնմխելիությունը չի կարող չեղարկել հանցագործությունը: Այդ մեղադրական հայցը կարող է հասնել մինչեւ Հաագայի միջազգային քրեական դատարան, քանի որ թուրքական իրավագիտությա մեջ նախագահի անպատասխանատվությա նեւ անձեռնմխելիության միջեւ տարբերություն կա: Թուրքիայում նախագահը կարող է մեղադրվել միայն հայրենիքի դավաճանության մեջ: Այսինքն` լիազորության հետ կապ չունեցող հանցագործությունները նրան չեն ազատում պատասխանատվությունից (Թուրքիայի սահմանադրության 105-րդ հոդված): Դատական հայցը Էրդողանի եւ նրա թիմի դեմ հաշիվ պահանջելու որոշման վճռականության արտահայտությունն է», -ասել է Մեմեթ Քըլըչը:
