Քաղաքացիական դատավարության նոր օրենսգրքի առաջին քայլերը

Արմեն Վարդանյանը ֆեյսբուքյան իր էջում գրում է.
1998 թվականին ընդունված և 1999թ. հունվարի 1-ին ուժի մեջ մտած ՀՀ քաղաքացիական դատավարության օրենսգիրքն իր ժամանակի կարևոր իրավական ակտերից էր: Դրական հատկանիշների կողքին օրենսգիրքն ուներ նաև թերություններ, որոնց մի մասն առկա էր ընդունման պահին, մյուսներն ի հայտ եկան գործնական կիրառման ընթացքում: ՀՀ սահմանադրության 2015թ. դեկտեմբերի 6-ին տեղի ունեցած փոփոխությունների արդյունքում հրատապ դարձավ ՀՀ քաղաքացիական դատավարության նոր օրենսգրքի ընդունումը, ինչպես նաև հարակից այլ օրենքներում փոփոխություններ և լրացումներ կատարելը:
ՀՀ կառավարության ս.թ. հունիսի 16-ի նիստի օրակարգում է օրենսգրքի նախագծին և հարակից օրենքների փոփոխություններին հավանություն տալու հարցը: Նոր օրենսգիրքը բաղկացած է 8 բաժնից: 1-ին բաժնում շարադրված են հիմնական դրույթները, քաղաքացիական դատավարության սկզբունքները, գործերի ենթակայությունը և ընդդատությունը, դատարանի կազմը, ինքնաբացարկը և բացարկը և այլն: 2-րդ բաժինը բաղկացած է 7 ենթաբաժնից, որտեղ լուսաբանվում են 1-ին ատյանի դատարանում գործերի քննության ընդհանուր կարգը, հատուկ հայցային վարույթները, հատուկ վարույթները, պարզեցված ընթացակարգերը և այլն: 3-րդ բաժնի ընդհանուր վերնագիրն է «Վարույթը վերաքննիչ դատարանում», 4-րդ բաժնինը` «Վարույթը վճռաբեկ դատարանում»: Այնուհետև լուսաբանվում են գործերի նոր քննությունը, դատական ակտերը նոր երևան եկած կամ նոր հանգամանքներով վերանայելու վարույթը, օտարերկրյա անձանց մասնակցությամբ գործերի վարույթը և այլն:
Ակնկալվում է, որ սույն նախագծերն ընդունվելու դեպքում կկենսագործվեն «ՀՀ իրավական և դատական բարեփոխումների 2012-2016թթ. ռազմավարական ծրագիրը և ծրագրից բխող միջոցառումների ցանկը հաստատելու մասին» ՀՀ նախագահի 2012թ. հուլիսի 1-ի կարգադրությամբ նախատեսված քաղաքացիական արդարադատության արդյունավետության բարձրացմանն ուղղված միջոցները, կապահովվի դատավարությունում մրցակցության և գործը ողջամիտ ժամկետում քննելու սկզբունքների կենսագործումը, առաջին ատյանի և վերաքննիչ դատարաններում գործերի միատեսակ քննությունը:
Կառավարության հավանությանն արժանանալու դեպքում օրենսգրքի նախագիծը և մի շարք օրենքների փոփոխության նախագծերը սահմանված կարգով կներկայացվեն ՀՀ Ազգային ժողով:
