Վենետիկի հանձնաժողովը հավանության է արժանացրել ՀՀ ԸՕ մասին համատեղ կարծիքը

Վենետիկի հանձնաժողովը հունիսի 10-11-ը հավանության է արժանացրել Հայաստանի ընտրական օրենսգրքի նախագծի համատեղ կարծիքը: Ինչպես հաղորդում է «Արմենպրես»-ը, կարծիքում նշվում է, որ թե Վենետիկի հանձնաժողովը, թե ԵԱՀԿ/ԺՀՄԻԳ-ը ուշի ուշով հետևել են Հայաստանի Ընտրական օրենսգրքում փոփոխություններին և իրենց կարծիքն են հայտնել ընթացող զարգացումների վերաբերյալ:

Նրանք ընդգծել են, որ բացառապես ժողովրդավարական ընտրություններ անցկացնելու առանցքային մարտահրավերներից է հետաքրքրված բոլոր կողմերի քաղաքական կամքի դրսևորումը և օրենքի տառին և ոգուն հավատարիմ լինելը: Այդուհանդերձ, արձանագրվել է, որ բարեփոխումների ժամանակը շատ կարճ էր, քանի որ Սահմանադրությունը ենթադրում է, որ նոր օրենսգիրքը ուժի մեջ էր մտնելու 2016 թվականի հունիսի 1-ից: Հանձնաժողովի անդամները փաստել են, որ ընտրական համակարգի կայունությունն առանցքային սկզբունք է և հավասարապես կարևոր է անհրաժեշտ ժամանակ ունենալ հանրային քննարկումներ անցկացնելու համար` ունենալու կոնսենսուս և վստահություն  ընտրական օրենսդրության մեջ հիմնական փոփոխությունների շուրջ:

Վենետիկի հանձնաժողովից փաստել են, որ նոր ընտրական օրենսգիրքը կարող է բավարար հիմք հանդիսանալ ժողովրդավարական ընտրությունների անցկացման համար:

Որպես մտահոգության առարկա է առանձնացվել այն, որ դեռևս բավարար միջոցներ չկան քվեարկողների ցուցակների ճշգրտության նկատմամբ վստահության ամրապնդման նպատակով: Բացի այդ, օրենսգրքի նախագիծը հաշվի չի առել նախկին երաշխավորումները` կապված բողոքարկման արդյունավետության, նախընտրական գործունեության ժամանակ ֆինանսավորման թափանցիկության և հաշվետվության հետ:

Համատեղ եզրակացության մեջ Վենետիկի հանձնաժողովն ու ԵԱՀԿ/ԺՀՄԻԳ-ն առաջարկել են Հայաստանի Հանրապետության իշխանություններին` աջակցել ընտրական օրենսդրության բարելավմանը և դրանով իսկ այն ավելի մոտեցնել ԵԱՀԿ հանձնառություններին ու եվրոպական և միջազգային չափանիշներին: Նրանք ընդգծել են, որ օրենքի արդյունավետ և անկողմնակալ կիրառումն անհրաժեշտ է` ապահովելու միջազգային չափանիշներին համապատասխան ընտրությունների անցկացումը:
