Լրագրող Ադրինե Թորոսյանը Վերաքննիչ դատարանում էլ հաղթեց

Վերաքննիչ քաղաքացիական դատարանը՝ նախագահությամբ դատավոր Ալվարդ Հունանյանի, մասնակցությամբ դատավորներ Կարինե Հակոբյանի, Արթուր Սմբատյանի, քաղաքացիական գործով՝ ըստ հայցի Կարինե Ստեփանյանի ընդդեմ Ադրինե Թորոսյանի, երրորդ անձինք «Լոռի Թի-վի» ՍՊԸ-ի և «Հրապարակ» օրաթերթի՝ պատվին արժանապատվությանը և գործարար համբավին պատճառված վնասի հատուցման պահանջի մասին Լոռու մարզի ընդհանուր իրավասության դատարանի վճռի դեմ հայցվորի կողմից բերված վերաքննիչ բողոքը մերժել է:

Վերաքննիչ դատարանն արձանագրել է, որ սույն քաղաքացիական գործով ընդհանուր իրավասության դատարանը՝ նախագահությամբ դատավոր Վարդուհի Հովնանյանի, «բազմակողմանի, լրիվ և օբյեկտիվ հետազոտել և պատշաճ գնահատականի է արժանացրել գործում առկա բոլոր ապացույցները, նշել դատարանի կողմից պարզված գործի հանգամանքները, ապացույցները, որոնց վրա հիմնված են դատարանի հետևությունները և իրավահարաբերությունը վերաբերելի օրենքների ճիշտ կիրառմամբ, կայացրել է օրինական և հիմնավորված վճիռ»:

Վերաքննիչ դատարանն արձանագրել է, որ առաջին ատյանի դատական ակտը բեկանելու և գործը նոր քննության ուղարկելու հիմքերը բացակայում են, ուստի հօգուտ Ադրինե Թորոսյանի կայացված վճիռը թողնվում է օրինական ուժի մեջ:

Վերաքննիչ դատարանը սույն գործի փաստերի հաշվառմամբ, իրավական նորմերի, ՀՀ վճռաբեկ դատարանի որոշումների լույսի ներքո հանգել է եզրակացության, որ Ադրինե Թորոսյանը հայցվորի պատիվը արժանապատվությունը կամ գործարար համբավը արատավորելու նպատակ չի հետապնդել, նրա արտահայտությունները չեն կարող դիտվել որպես վիրավորանք և զրպարտություն, քանի որ, լինելով լրագրող՝ նա օգտվել է ՀՀ Սահմանադրությամբ իրեն վերապահված՝ կարծիքն ազատ արտահայտելու իրավունքից և իր լուսաբանումով ընդամենը տեղեկատվություն է հաղորդել հանրությանը:

Հիշեցնենք, որ լրագրողի մասնագիտական գործունեության արդյունքում Ադրինե Թորոսյանի հրապարակումների հիման վրա բարոյական վնասի հատուցման պահանջով նրա դեմ դատարան հայց ներկայացրած Վանաձորի թիվ 8 դպրոցի տնօրեն Կարինե Ստեփանյանի միջնորդությամբ երկրորդ տարին արգելանքի տակ էր լրագրողի հայրական տունը:
