Սյունիքի մարզի ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ Որոտանի գյուղապետ Սերյոժա Ամիրխանյանի կողմից պաշտոնեական դիրքի չարաշահում կատարելու համար: Ըստ Դատական տեղեկատվական համակարգի՝ Որոտան համայնքի ղեկավար Սերյոժա Ամիրխանյանին մեղադրանք է առաջադրվել այն բանի համար, որ նա հանդիսանալով պաշտոնատար անձ, պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով, անձնական այլ շահագրգռվածությունից ելնելով՝ համայնքային սեփականություն հանդիսացող վարելահողում կատարել է ցանք:

Այնուհետեւ հայտարարություն է տվել նշված վարելահողի վարձակալության տրամադրման մրցույթի անցկացման վերաբերյալ եւ մրցույթի պահանջի խախտմամբ հաղթող ճանաչված նույն մրցույթային հանձնաժողովի անդամ որդու՝ Վոլոդյա Ամիրխանյանի հետ կնքել է անշարժ գույքի վարձակալության պայմանագիր: Սերյոժա Ամիրխանյանը վերոհիշյալ հանցագործության համար մեղադրվում է ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի առաջին մասով:

Ըստ այս հոդվածի՝ պաշտոնատար անձի կողմից իր պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելը կամ ծառայողական պարտականությունները չկատարելը՝ շահադիտական, անձնական այլ շահագրգռվածությունից կամ խմբային շահերից ելնելով, պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից երեքհարյուրապատիկի չափով, կամ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ առավելագույնը հինգ տարի ժամկետով, կամ կալանքով՝ երկուսից երեք ամիս ժամկետով, կամ ազատազրկմամբ՝ առավելագույնը չորս տարի ժամկետով: Նախկինում դատվածություն ունեցող գյուղապետին ստորագրությամբ բաց են թողել:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի`օրինական ուժի մեջ մտած դատավճռով:
