Կառավարությունը լրացուցիչ աշխատանքային երաշխիքներ է սահմանում դիրքեր մեկնած կամավորականների համար

Խորհրդարանն արտահերթ նիստում քննարկում է Հայաստանի Հանրապետության աշխատանքային օրենսգրքում լրացումներ կատարելու մասին օրենքի նախագիծը, որով նախատեսվում է աշխատանքային լրացուցիչ երաշխիքներ սահմանել այն անձանց համար, ովքեր ապրիլի 2-ից Ադրբեջանի կողմից Արցախի դեմ սանձազերծված ռազմական ագրեսիայի ընթացքում կամավոր հիմքունքներով մեկնել են դիրքեր: Հիմնական զեկուցող, ՀՀ աշխատանքի և սոցիալական հարցերի նախարար Արտեմ Ասատրյանը նշեց, որ օրենքի նախագծի մշակումը պայմանավորված է 2016 թվականի ապրիլի 1-ից հետո Ադրբեջանի Հանրապետության կողմից 1994 թվականի զինադադարի համաձայնագրի կապակցությամբ կամավորական հիմունքներով մարտական գործողությունների գոտի մեկնող եւ զինվորական ծառայության մեջ չգտնվող անձ համարվող աշխատողների համար աշխատանքային լրացուցիչ երաշխիքներ սահմանելու անհրաժեշտությամբ:

«2016 թվականի ապրիլի 1-ից հետո Ադրբեջանի Հանրապետության կողմից 1994 թվականի զինադադարի համաձայնագրի խախտման կապակցությամբ, ինչպես նաև հետագայում հակառակորդի կողմից հնարավոր նախահարձակ գործողություններով պայմանավորված՝ կամավորական համարվող աշխատողների աշխատանքային իրավունքների լիարժեք պաշտպանության համար իրավական հիմքերի ապահովման նպատակով անհրաժեշտ է Հայաստանի Հանրապետության աշխատանքային օրենսգրքով կամավորականների համար սահմանել աշխատանքային լրացուցիչ երաշխիքներ՝ աշխատատեղի պահպանում և վարձատրության կազմակերպում՝ կամավորական հիմունքներով մարտական գործողություններին մասնակցելու ժամանակահատվածում»,-նշեց Ասատրյանը:

Նախարարը հավելեց, որ նախագծով նաև նախատեսվում է առաջարկվող իրավական կարգավորումներին տալ հետադարձ ուժ՝ դրանք տարածելով 2016 թվականի ապրիլի 1-ից հետո ծագած հարաբերությունների վրա: Նախագծի ընդունման դեպքում ակնկալվում է կամավորական համարվող աշխատողների աշխատանքային իրավունքների լիարժեք պաշտպանության ապահովում՝ 2016 թվականի ապրիլի 1-ից հետո կամավորական հիմունքներով մարտական գործողություններին մասնակցելու ժամանակահատվածում այդ աշխատողների համար աշխատանքային լրացուցիչ երաշխիքների  սահմանմամբ:
