Վարույթ է հարուցվել հայտնի դատավոր Մացոյի դեմ

«Ժամանակ» թերթը գրում է. «Մարդու իրավունքների պաշտպան Կարեն Անդրեասյանը դիմել է դատավորների ընդհանուր ժողովի էթիկայի եւ կարգապահական հարցերի հանձնաժողովին Երեւանի Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի դատավոր Մնացական Մարտիրոսյանի նկատմամբ վարույթ հարուցելու վերաբերյալ:
Դիմումի համար հիմք է հանդիսացել դատապարտյալ Արթուր Այվազյանի պաշտպան Հայկ Ալումյանի բողոքը, որով փաստաբանը դատարանից խնդրել էր իր պաշտպանյալի մասով վերացնել ՀՀ արդարադատության նախարարության քրեակատարողական ծառայության կենտրոնական մարմնի տեղաբաշխման հանձնաժողովի համապատասխան որոշումը, որով մերժվել էր փոխել Արթուր Այվազյանի ռեժիմը միայն այն պատճառով, որ նա դատապարտված լինելու ժամանակ կրկին հանցագործություն է կատարել եւ բացի դրանից՝ պատիժը կրելու ընթացքում 9 անգամ ենթարկվել է կարգապահական տույժի, չի խրախուսվել:
Այս որոշման դեմ Ալումյանը վերաքննիչ բողոք է բերել, եւ Վերաքննիչ քրեական դատարանը հուլիսի 1-ին մասնակիորեն բավարարել է Ալումյանի վերաքննիչ բողոքը՝ փոխելով առաջին ատյանի դատարանի որոշումը եւ տեղաբաշխման հանձնաժողովին պարտավորեցնելով վերացնել ՀՀ վերաքննիչ քրեական դատարանի որոշմամբ արձանագրված դատապարտյալի իրավունքի խախտումը:
Օմբուդսմենը համարել է, որ առաջին ատյանի դատարանի դատավոր Մնացական Մարտիրոսյանը դուրս է եկել օրենքով իրեն վերապահված լիազորությունների շրջանակից եւ թույլ է տվել ՀՀ քրեական դատավարության օրենսգրքի 7-րդ հոդվածի 1-ին մասի, 429-րդ հոդվածի 1-ին մասի, 358-րդ հոդվածի դրույթների ակնհայտ եւ կոպիտ խախտում, ինչի հետեւանքով խախտվել են նաեւ Սահմանադրության 5-րդ, 18-րդ եւ 19-րդ հոդվածներով սահմանված դրույթները:
Բացի այդ, Օմբուդսմենը կարծում է, որ դատապարտյալի պաշտպանի բողոքի մերժման որոշումը պատշաճ պատճառաբանված չի եղել:
«Այսպիսով, հիմք ընդունելով վերոգրյալը՝ գտնում ենք, որ Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի դատավոր Մնացական Մարտիրոսյանը թույլ է տվել դատավարական նորմերի ակնհայտ եւ կոպիտ խախտում, ինչը ՀՀ դատական օրենսգրքի 153-րդ հոդվածի 2-րդ մասի, 2-րդ կետին համապատասխան հիմք է հանդիսանում դատավորին կարգապահական պատասխանատվության ենթարկելու համար»,- դատավորների ընդհանուր ժողովի կարգապահական հանձնաժողովին ուղարկված դիմումում գրել է Օմբուդսմենը»:
