Ընտրական օրենսգրքի վերաբերյալ ութ առաջարկ

«Իրազեկ քաղաքացիների միավորումը» ՀՀ կառավարություն եւ Ազգային ժողովի պետաիրավական հարցերի հանձնաժողով է ուղարկել Ընտրական օրենսգրքի նախագծի վերաբերյալ ութ առաջարկ: Փաստաթղթում տեղ են գտել նախկինում հիմնականում չքննարկված, ինչպես նաեւ կոնկրետ ձեւակերպում պահանջող առաջարկությունները:
Մասնավորապես, թվով ութ առաջարկությունները հետեւյալի մասին են: Քվեարկության մասնակցած անձանց ցուցակների հասանելիությունը: Համաձայն մեր առաջարկի, քվեարկության հաջորդ օրը տարածքային ընտրական հանձնաժողովները կուսակցությունների ու դիտորդական կազմակերպությունների դիմումի հիման վրա վերջիններիս տրամադրում են էլեկտրոնային գրանցման սարքերի միջոցով գրանցված բոլոր ընտրողների հերթական համարների ցանկը:
Նախկինում առկա տարընկալումները բացառելու նպատակով օրենքում հստակ սահմանել, որ դիտորդները, ԶԼՄ ներկայացուցիչներն ու վստահված անձինք իրավունք ունեն քվեարկության օրը՝ ժամը 20:00-ից հետո, մուտք գործել տեղամաս: Հստակ ամրագրել այն դեպքերը, երբ դիտորդին, ԶԼՄ ներկայացուցչին կամ վստահված անձին կարելի է հանել ընտրական տեղամասից: Նախկինում առկա տարընկալումները բացառելու եւ ԿԸՀ պաշտոնական պարզաբանումը օրենսգրքում ներառելու նպատակով օրենքում հստակ սահմանել, որ դիտորդները, ԶԼՄ ներկայացուցիչներն ու վստահված անձինք իրավունք ունեն առանց լուսանկարահանելու, պատճենահանելու եւ քաղվածքներ կատարելու ծանոթանալ ընտրողների ստորագրած ցուցակներին ու քվեարկության կտրոններին:
Սահմանել, որ ընտրողների գրանցման էլեկտրոնային սարքերի էկրանին միշտ երեւա քվեարկած ընտրողների թիվը, իսկ քվեարկության վերջում տպվող տեղեկանքի վրա երեւա ժամ առ ժամ քվեարկած քաղաքացիների քանակը՝ լցոնումները բացառելու նպատակով: Սահմանել, որ գրանցամատյանում տեղ գտնեն ոչ միայն վստահված անձի, այլեւ դիտորդի ու ԶԼՄ ներկայացուցչի կողմից արձանագրված խախտումները՝ քվեարկության պրոցեսի մասին ամբողջական գնահատական տալու հնարավորություն ստեղծելու համար:
Քանի որ երկարացվել են տեղամասային հանձնաժողովի կողմից քվեարկության ամփոփման ժամկետները, առաջարկվում է առնվազն նույնքան երկարացնել բողոքարկման (արդյունքները անվավեր ճանաչելու եւ վերահաշվարկի դիմուների ներկայացման) ժամկերները՝ առավել եւս, որ անգամ առկա ժամկետները խիստ անբավարար էին: Քանի որ ընտրողների էլեկտրոնային գրանցման սարքերը պետք է կոչված լինեն բացառելու մարդկային գործոնը, առաջարկում ենք առանձնակի վերահսկողություն սահմանել այն դեպքերի համար, երբ էլեկտրոնային սարքը չի տեսնում ընտրողի անձը հաստատող փաստաթուղթը եւ դրա համարը մուտքագրվում է ձեռքով»,- նշված է հաղորդագրության մեջ:
Նշենք, որ առաջարկությունների հիմքում ընկած են ԵԱՀԿ/ԺՀՄԻԳ-ի ու ԵԽ Վենետիկի հանձնաժողովի՝ օրենսգրքի նախագծի մասին համատեղ կարծիքը, Սահմանադրական հանրաքվեից հետո հրապարակված ԵԱՀԿ/ԺՀՄԻԳ-ի առաջարկությունները, ԵԽ Վենետիկի հանձնաժողովի դիրքորոշումը, Մարդու իրավունքների եվրոպական դատարանի որոշումները, ՀՀ Կենտրոնական ընտրական հանձնաժողովի պաշտոնական պարզաբանումները եւ ՀՀ կառավարության ներկայացուցիչների առաջարկությունները:
