Ինչո՞ւ է ոստիկանությանը բժիշկներից տվյալներ է հավաքում քաղցկեղով հիվանդ անձանց մասին.«Առավոտ»

Արդարադատության նախարարության Անձնական տվյալների պաշտպանության գործակալությունը գրություն էր ստացել «Human Rights Watch» կազմակերպությունից այն մասին, որ ոստիկանությանը բժիշկներից տվյալներ է հավաքում քաղցկեղով հիվանդ անձանց մասին։
Ըստ այդ գրության՝ ամեն ամիս տվյալներ էր հավաքվում նաև այն մասին, թե ով ինչ դիագնոզ ունի, ինչքան հոգեմետ դեղ է ներարկում ստանում, ով է ներարկողը, անձնագրային տվյալները և այլն։ Այս տեղեկատվությանը ճշտելու կապակցությամբ «Առավոտը» զրուցել է ՀՀ արդարադատության նախարարության Անձնական տվյալների պաշտպանության գործակալության պետ Շուշան Դոյդոյանի հետ։ Ներկայացնում ենք զրույցից մի հատված.
-Անձնական տվյալների պաշտպանության գործակալությունը սեփական նախաձեռնությամբ վարչական վարույթ հարուցեց, անհանգստանալով առկա տեղեկություններով։ Մոտ երկու ամիս տևեց ամբողջ վարույթի գործընթացը։
Հրավիրել ենք առողջապահության նախարարությանը, ոստիկանաթյան ներկայացուցիչներին, լսել ենք իրենց տեսակետները խնդրի կարգավորման վերաբերյալ, կայացնելով որոշումը։ Որոշեցինք, որ այո, թեև հնարավորությունը սահմանված է, բայց փոխանցման գործընթացը հակասում է «Անձնական տվյալների մասին» օրենքին։ Հաշվի առնելով, որ դրանք նաև բժշկական գաղտնիք են, և որ բաժհաստատությանը հայտնի են դարձել, քանի որ անձը դրանք վստահել է բուժհաստատությանը։
- Ոստիկանությունը հիմնավորե՞ց, թե ինչի համար էր բժշկական գաղտնիք պարունակող ինֆորմացիա ձեռք բերում։
- Հիմնավորումն այն էր, որպեսզի ընդհանրապես վերահսկի հոգեմետ դեղերի փոխանցումը բաժհաստատաթյաններից հիվանդներին, որպեսզի ոստիկանությունը վստահ լինի, որ ամեն ինչ տեղի է ունենում ըստ սահմանված կարգի, հիվանդը ստանում է այնքան չափաբաժին, որքան որ պետք է ստանա, շուկան վերահսկելու նպատակով։
–Ի՞նչ է սպասվում վարչական վարույթից հետո ոստիկանությանը։
–Մենք կարծում ենք, որ նրանց հաջորդ քայլը պիտի լինի որոշման նախագիծ մշակելը, օրենքում փոփոխություն առաջարկելը, որով հստակ կկանոնակարգվի ողջ գործընթացը՝ բժշկական հաստատություն-բժիշկ–ոստիկանություն փոխհարաբերությունների համատեքստում։
