Չգործած հանցանքի մեջ մեղադրվող ոստիկանը արդարացվել է

Հատուկ քննչական ծառայությունում ոստիկանի կողմից քաղաքացու նկատմամբ բռնություն գործադրելու դեպքի առթիվ Քրեական օրենսգրքի 309-րդ հոդվածի երկրորդ մասով քրեական գործ էր հարուցվել:
Մասնավորապես, ՀՔԾ լրատվական ծառայությունից մեզ տեղեկացրին, որ քաղաքացի Լուսիկ Կ.-ն հաղորդել էր այն մասին, որ 2015թ-ի դեկտեմբերի 17-ին Երեւան քաղաքի Բագրատունյաց 10 շենքի մոտից ոստիկանության ծառայողներն իրեն եւ ընկերուհուն՝ Սուսաննա Ս.-ին, մարմնավաճառությամբ զբաղվելու համար նստեցրել են պարեկային ավտոմեքենա եւ բերման ենթարկել ոստիկանության Շենգավիթի բաժին: Այնուհետեւ ոստիկան Գագիկ Ա.-ն հայհոյել եւ բռունցքով հարվածել է իրեն՝ պատճառելով մարմնական վնասվածքներ:
Սակայն հետո Լուսիկ Կ.-ն, որպես տուժող լրացուցիչ ցուցմունքով հայտնել է, որ ոստիկանության աշխատակից Գագիկ Ա.-ն իրականում իրեն չի հարվածել եւ մարմնական վնասվածքներ չի պատճառել: Ավելին՝ դեպքի օրը ինքը չի ենթարկվել ոստիկանների օրինական պահանջներին, ոստիկանության Շենգավիթի բաժնում գտնվելու ժամանակ շարունակել է հայհոյանքներ հնչեցնել: Իսկ ձեռքի շրջանում մարմնական վնասվածքները ստացել է բերման ենթարկվելիս` ոստիկան Գագիկ Ա.-ին չենթարկվելու պատճառով վերջինիս կողմից իրավաչափ հարկադրանք կիրառելու արդյունքում:
Քրեական գործի նախաքննության ընթացքում ձեռք բերված ապացույցներով չեն հիմնավորվել ոստիկանության աշխատակցի կողմից հանցագործություն կատարելու հանգամանքները, եւորոշում է կայացվել վերջինիս նկատմամբ չիրականացնել քրեական հետապնդում:
Եւ քանի որ Լուսիկ Կ.-ի արարքում եղելեն սուտ մատնություն կատարելու հանցակազմի հատկանիշներ՝նրան մեղադրանք է առաջադրվել Քրեական օրենսգրքի 333-րդ հոդվածի երկրորդ մասի առաջին կետով:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
