ԵԱՏՄ տարածքում ապրանքը կգրանցվի պարզ եղանակով

ՀՀ կառավարության ս.թ. մարտի 31-ի նիստի որոշումներից 2-ը թելադրված էին ԵԱՏՄ-ին Հայաստանի անդամակցությամբ: Ավելի վաղ ընդունված որոշումներից մեկով ՀՀ լիազոր մարմինները պարտավորվել են ՀՀ կառավարության հաստատմանը ներկայացնել յուրաքանչյուրի համակարգման ոլորտում գտնվող երրորդ երկրի հետ սահմանափակման ենթակա ապրանքի ներմուծման և արտահանման ընթացակարգերը: Այս պահանջի կատարման նպատակով ՀՀ առողջապահության նախարարությունը գործադրի քննարկմանն էր ներկայացրել մի որոշման նախագիծ, որով կարգավորվելու են թմրամիջոցների կամ հոգեմետ նյութերի կամ կառավարության սահմանած` դրանց պրեկուրսորների արտադրության, արտահանման, ներմուծման կամ մեծածախ առևտրի իրականացման արտոնագրման կարգերը և արտոնագրի ձևերը:
Բացի այդ, նախագծով սահմանվել են մարդու օրգանների և հյուսվածքների, արյան և դրա բաղադրամասերի, ինչպես նաև թմրանյութերի և հոգեմետ նյութերի ցանկերը` հիմք ընդունելով Եվրասիական տնտեսական հանձնաժողովի կոլեգիայի 2015թ. նոյեմբերի 17-ի հմ.150 որոշման 2-րդ հավելվածով հաստատված ցանկի 2.12 և 2.21 կետերը:
Որոշմամբ ստեղծվում է վերը նշված նյութերի արտոնագրման միասնական կարգ, կարգավորվում են համապատասխան հարաբերությունները: Որոշումն հստակ սահմանել է հայտատուների շրջանակը, անհրաժեշտ փաստաթղթերի ցանկը, արտոնագրի տրամադրումը մերժելու, տրամադրված ատոնագիրը կասեցնելու և դադարեցնելու հիմքերը, արտոնագրի ձևերը, մաքսային մարմնից արտոնագրի կատարման վերաբերյալ տեղեկությունն էլեկտրոնային եղանակով լիազոր մարմին ներկայացնելու կարգը և այլն:
Մյուս որոշմամբ ՀՀ կառավարությունը համաձայնություն է տվել «ԵԱՏՄ ապրանքային նշանների, սպասարկման նշանների և ապրանքի ծագման տեղանվան մասին» պայմանագրի կնքման առաջարկությանը: Նշված օբյեկտների գրանցման իրավասությունը վերապահված է ԵԱՏՄ անդամ պետությունների արտոնագրային գերատեսչություններին:
Պայմանագիրը գործողության մեջ մտնելու դեպքում տնտեսվարող սուբյեկտները հնարավորություն կունենան 1 հայտ ներկայացնելու միջոցով ԵԱՏՄ տարածքում գրանցել հատկապես այն ապրանքը, որը նախատեսված է այդտեղ շրջանառության մեջ դնելու համար: Դա նրանց հնարավորություն կտա օգտվել ապրանքային նշանի նկատմամբ բացառիկ իրավունքի պաշտպանության այն մեխանիզմներից, որոնք նախատեսված են ԵԱՏՄ անդամ պետությունների ազգային օրենսդրությամբ, քանի որ պայմանագրով նախատեսված գրանցումն իրավական առումով հավասարեցված է ազգային գրանցմանը:
