Սուտ մատնության փաստով հարուցվել է քրեական գործ

 ՀՀ արդարադատության նախարարության «Արմավիր» քրեակատարողական հիմնարկի կալանավոր, մի շարք գողությունների կատարման մեջ մեղադրվող, Վրաստանի Հանրապետության քաղաքացի  Վլադիմիր Գ.-ն, նախազգուշացված լինելով ակնհայտ սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, հաղորդում էր տվել այն մասին, որ 2014թ. փետրվարի 26-ին իրեն բերման են ենթարկել ՀՀ ոստիկանության քրեական հետախուզության գլխավոր վարչություն և խուզարկել, որի արդյունքում իր մոտից ոչինչ չի հայտնաբերվել, սակայն  ոստիկանության աշխատակցի կողմից կազմվել է կեղծ  արձանագրություն, թե, իբր, ընթերակաների ներկայությամբ իր մոտից հայտնաբերվել են բանալիներ և գողության համար նախատեսված մետաղյա կտորներ, իսկ ինքն առանց կարդալու ստորագրել է այդ արձանագրության տակ, քանի որ հայերեն գրավոր լեզվին չի տիրապետում, իսկ խուզարկության ընթացքում ընթերականեր չեն եղել:

Դեպքի առթիվ ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով ՀՀ հատուկ քննչական ծառայությունում հարուցվել էր քրեական գործ: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից:

Հիշյալ քրեական գործի նախաքննության ընթացքում պատշաճ ընթացակարգով ստուգվել են ՀՀ արդարադատության նախարարության «Արմավիր» քրեակատարողական հիմնարկի կալանավոր  Վլադիմիր Գ.-ի հաղորդման մեջ մատնանշված դրվագների բոլոր հանգամանքները:

Մասնավորապես՝ քննչական մի շարք գործողությունների արդյունքում հիմնավորվել է, որ Վլադիմիր Գ.-ին ոստիկանության քրեական հետախուզության գլխավոր վարչությունում անձնական խուզարկության ենթարկելու ժամանակ ներկա են եղել ընթերականեր Հովիկ Պ.-ն և Արիստակես Ա.-ն, որոնք ևս իրենց ստորագրություններով և լրացուցիչ բացատրություններով հայտնել են, որ  Վլադիմիր Գ.-ի անձնական խուզարկությամբ հայտնաբերվել են բանալիներ ու մետաղյա կտորներ:

Այսինքն՝ Վլադիմիր Գ.-ն, գիտակցելով իր կողմից տրված հաղորդման կեղծ լինելը, հանցագործության կատարման մեջ հանիրավի մեղադրել է ոստիկանության ծառայողին:

ՀՀ հատուկ քննչական ծառայությունում  կատարված նախաքննության ընթացքում ձեռք բերված ապացույցներով չեն հիմնավորվել ՀՀ ոստիկանության աշխատակցի կողմից առերևույթ հանցագործություն կատարելու հանգամանքները, ուստի որոշում է կայացվել վերջինիս նկատմամբ քրեական հետապնդում չիրականացնել` հանցագործության դեպքի բացակայության հիմքով:

Միաժամանակ հաշվի առնելով, որ Վլադիմիր Գ.-ի արարքում առերևույթ կան սուտ մատնություն կատարելու հանցակազմի հատկանիշներ, ուստի հիշյալ դեպքի առթիվ ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ:

Կատարվում է նախաքննություն:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
