Գնդապետը մեղադրվում է պաշտոնեական դիրքը չարաշահելու համար

Ավան եւ Նոր-Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում հարուցվել է քրեական գործ՝ գնդապետի կողմից իր որդուն ծառայողական պարտականությունները կատարելուց պարբերաբար ազատելու դեպքի առթիվ:
Մասնավորապես, մեր ունեցած տեղեկություններով՝ Զարմիկ Մարկոսյանին մեղադրանք է առաջադրվել այն բանի համար, որ հանդիսանալով ՀՀ ՊՆ 24236 զորամասի հրամանատարի նյութատեխնիկական ապահովման գծով տեղակալ, կոչումով գնդապետ՝ որդու՝ նույն զորամասի կուրսանտ Գնել Թևոսյանի՝ ինստիտուտում սովորելու համար արտոնյալ պայմաններ ստեղծելու նպատակով՝ զբաղվել է որդու հովանավորչությամբ:
Չարաշահելով պաշտոնեական դիրքը՝ 2014թ. օգոստոս ամսից մինչև 2015թ հունվարի 28-ը ներառյալ հանձնարարել է ենթակա սպաներին, պարբերաբար, առանց համապատասխան փաստաթղթային ձևակերպման, իր որդուն մի քանի ժամ տևողությամբ ազատել ծառայողական պարտականությունները կատարելուց եւ թույլատրել բացակայել զորամասի տարածքից:
Գնդապետին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 375 հոդվածի առաջին մասով: Նշենք, որ ըստ Քրեական օրենսգրքի վերոնշյալ հոդվածի՝ պետի կամ պաշտոնատար անձի կողմից իշխանությունը կամ պաշտոնեական դիրքը չարաշահելը, եթե այդ արարքները կատարվել են շահադիտական, անձնական այլ շահագրգռվածությունից կամ խմբային շահերից ելնելով, եւ եթե դրանք էական վնաս են պատճառել՝ պատժվում են ազատազրկմամբ՝ երկուսից հինգ տարի ժամկետով:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
