Նորընտիր օմբուդսմենն առաջարկում է փոխել կանանց համամասնությունը

ՀՀ մարդու իրավունքների պաշտպանը սեփական նախաձեռնությամբ իրականացրել է ՀՀ ընտրական օրենսգրքի նախագծի ուսումնասիրություն՝ հաշվի առնելով ժողովրդավարության ամրապնդման ու մարդու իրավունքների ապահովման գործում ընտրական օրենսդրության առանցքային նշանակությունը: Այս մասին ասված է ՄԻՊ գրասենյակի տարածած հաղորդագրության մեջ։ Նշված առաջարկները սահմանված կարգով ներկայացվել են ՀՀ կառավարությանը և Ազգային ժողովին: Մասնավորապես, ընտրություններում կանանց պատշաճ ներկայացվածություն ապահովելու նպատակով օմբուդսմենի գրասենյակն արել է հետևյալ նկատառումները։
«Կանանց ընտրական իրավունքի ապահովումը Կանանց պասիվ ընտրական իրավունքի ապահովման կապակցությամբ պետք է արձանագրել գործող ընտրական օրենսգրքի համեմատությամբ առաջարկվող նախագծի որդեգրած առավել առաջադեմ մոտեցումը: Այսպես, նախագծի 84-րդ հոդվածի համաձայն՝ կուսակցության, կուսակցությունների դաշինքի և դաշինքում ընդգրկված կուսակցություններից յուրաքանչյուրի համապետական ընտրական ցուցակի առաջին մասում 2-րդ համարից սկսած՝ ցանկացած ամբողջ թվով հնգյակներում (2-6, 2-11, 2-16 և այդպես շարունակ` մինչև ցուցակի ավարտը) յուրաքանչյուր սեռի ներկայացուցիչների թիվը չպետք է գերազանցի 80 տոկոսը: Այս մոտեցման առավելությունը նրանում է, որ կանանց ներկայացվածությունն ապահովված է ոչ թե պարզապես կուսակցության ցուցակում, այլ ցուցակի յուրաքանչյուր հնգյակում, ինչը, անշուշտ, բարձրացնում է կանանց ընտրվելու հավանականությունը: Չնայած դրան, նախագիծը, այնուամենայնիվ, առաջարկում է կանանց առնվազն 20 տոկոս ներկայացվածություն, ինչը չի բխում այս բնագավառի միջազգային չափանիշներից:
Մասնավորապես, Վենետիկի հանձնաժողովն իր «Ընտրական համակարգերի դերը քաղաքականության մեջ կանանց ներկայացվածության վերաբերյալ զեկույցում արձանագրել է, որ արդյունավետ լինելու համար տարբեր սեռերին քվոտաները պետք է նախատեսեն առնվազն 30 տոկոս կանանց ներկայացվածությունը կուսակցությունների ցուցակներում: Հիմք ընդունելով նաև համաշխարհային փորձը՝ կանանց ներկայացվածության պատշաճ հնարավորություն ապահովելու համար ՄԻՊ-ն առաջարկվում է Նախագծում ամրագրել կանանց առնվազն 30 տոկոս ներկայացվածություն ապահովելու մեխանիզմ:
