ՀՔԱՎ-ը պահանջում է վարչական տույժի ենթարկել նախագահի աշխատակազմին

Այսօր Վարչական դատարանում կկայանա «ՀՔԱ Վանաձորի գրասենյակը՝ ընդդեմ ՀՀ նախագահի աշխատակազմի» գործով դատական նիստը: 2015 թվականի հունիսի 6-ին ՀՔԱՎ-ը տեղեկատվության հարցում է կատարել նախագահի աշխատակազմի ղեկավարին՝ 1992-2015 թվականների ընթացքում ՀՀ նախագահի կողմից զենքով պարգեւատրված անձանց եւ տրամադրված զենքերի նշանակության վերաբերյալ՝ խնդրելով տեղեկատվությունը տրամադրել ըստ առանձին տարիների եւ անձանց:

Հուլիսի 16-ի պատասխան գրությամբ ՀՀ նախագահի աշխատակազմը տեղեկատվությունը տրամադրել է մասնակիորեն՝ միայն 1998-2015թթ. զենքով պարգեւատրված անձանց թվի վերաբերյալ՝ պատճառաբանելով, որ պահանջվող տեղեկատվությունը պարունակում է անձնական կյանքի վերաբերյալ տեղեկություններ, որոնք, ՀՀ Սահմանադրության 23-րդ հոդվածի համաձայն, չի կարելի օգտագործել կամ տարածել առանց տվյալ անձանց համաձայնության: Իսկ ՀՔԱՎ կողմից հարցում ուղարկելու համար առիթ էին հանդիսացել Բուդաղյան եղբայրների սպանության գործով Սյունիքի մարզպետ Սուրիկ Խաչատրյանի տանն առգրավված զենքի օրինականության հետ կապված քննարկումները:

Հարցումներն ուղարկվել են ՀՀ նախագահի աշխատակազմ, ՀՀ կառավարությանն առընթեր ազգային անվտանգության եւ ոստիկանության ծառայություններ, ՀՀ կառավարություն, ՀՀ պաշտպանության նախարարություն: Բոլոր պետական կառույցները հայտնել են, որ չեն կարող տրամադրել այն անձանց տվյալները, որոնք պարգեւատրվել են զենքով՝ հղում կատարելով տարբեր իրավական նորմերին:
