Ցուցմունք տալուց հրաժարվող տուժողը ենթարկվել է քրեական պատասխանատվության

Ուրիշի գույքը դիտավորությամբ ոչնչացնելու փորձ կատարելու կասկածանքով ձերբակալված Արմեն Թամարյանը ՀՀ ոստիկանության ձերբակալված անձանց պահելու վայրերում վերահսկողություն իրականացնող հասարակական դիտորդական խմբի անդամներին 2014 թվականի հոկտեմբերի 26-ին հայտնել է, որ հանցագործություն կատարելու կասկածանքով բերման է ենթարկվել ոստիկանության Բազումի բաժին, հիշյալ բաժնի աշխատակիցների կողմից ենթարկվել է բռնության, այնուհետև ձերբակալվել է և տեղափոխվել ձերբակալվածների պահման վայր:
Դեպքի առթիվ ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 2-րդ մասի հատկանիշներով ՀՀ հատուկ քննչական ծառայությունում հարուցվել է քրեական գործ, որի նախաքննության ընթացքում Արմեն Թամարյանը որպես վկա հարցաքննվելիս նախազգուշացվել է ցուցմունք տալուց հրաժարվելու համար ՀՀ քրեական օրենսգրքի 339-րդ հոդվածով նախատեսված քրեական պատասխանատվության մասին, սակայն հիշյալ գործով պարզաբանման ենթակա հանգամանքների շուրÕ » հրաժարվել է ցուցմունք տալուց:
Այնուհետև Արմեն Թամարյանը, շարունակելով իր հանցավոր վարքագիծը, հետագայում քրեական գործով ճանաչվելով տուժող և կրկին նախազգուշացված լինելով ցուցմունք տալուց հրաժարվելու համար քրեական պատասխանատվության մասին, որպես տուժող հարցաքննության ժամանակ ևս հրաժարվել է ցուցմունք տալուց:
Պաշտոնատար անձանց կողմից բռնությամբ զուգորդված պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ հարուցված քրեական գործով վարույթը հանցակազմի բացակայության հիմքով կարճվել է, որի օրինականությունը ստուգվել է դատախազի կողմից, իսկ Արմեն Թամարյանի կողմից քրեական գործով ցուցմունքներ տալուց հրաժարվելու դեպքի առթիվ հարուցված քրեական գործի շրջանակներում վերջինիս մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 339-րդ հոդվածի 1-ին մասով:
ՀՀ հատուկ քննչական ծառայությունում ավարտվել է Արմեն Թամարյանի կողմից ցուցմունք տալուց հրաժարվելու դեպքի առթիվ ՀՀ քրեական օրենսգրքի 339-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցված քրեական գործի նախաքննությունը: Հիշյալ գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
