Past.am-ը շարունակում է ներկայացնել իրավաբանների, քաղաքական գործիչների, իրավապաշտպան ՀԿ-ների ներկայացուցիչների և այլ շահագրգիռ անձանց տեսակետները՝ կապված նոր Ընտրական օրենսգրքի նախագծի հետ:

Մեզ հետ զրույցում փաստաբան Նորայր Նորիկյանն ասաց, որ հետընթաց է համարում նոր նախագծի դրույթները: Ըստ նրա՝ խոսքը դիտորդների և ԶԼՄ-ների թվի սահմանափակման, վստահված անձանց իրավասությունների, ընտրական ցուցակների, էլեկտրոնային քվեարկության գաղափարի կիսատության մասին է:

Անդրադառնալով էլեկտրոնային քվեարկությանը՝ պարոն Նորիկյանն ասաց. «Խոսքը գնում է այն մասին, որ ընտրողն իր անձը հաստատող փաստաթղթով ներկայանում է ընտրական տեղամաս և առաջինը մոտենում է ոչ թե տեղամասային հանձնաժողովի անդամին, այլ տեխնիկական սարքավորման մասնագետին:

Առաջարկվող օրենսգիրքը չի սահմանում, թե այդ մարդն ո՞վ է, ի՞նչ լիազորություններ ունի, ո՞ւմ է հաշվետու: Նրան են մոտենալու, տրամադրելու կենսաչափական անձնագիրը, նույնականացման քարտը կամ սովորական անձնագիրը: Սարքի օգնությամբ մասնագետը պարզելու է՝ քաղաքացին կարո՞ղ է քվեարկել: Եթե քաղաքացին այլ տեղ չի քվեարկել և ունի ՀՀ-ում ընտրելու իրավունք, ապա վառվելու է կանաչ լույս:

Եթե մարդն իր անձը հաստատող փաստաթղթով է մասնակցում և կրկին այլ տեղ չի քվեարկել, ապա նորից վառվելու է կանաչ լույս, բայց նրա նկարը չի երևալու: Եթե մարդը չունի տեղամասում ընտրելու իրավունք, ապա վառվելու է կարմիր լույսը: Եթե այլ տեղ ընտրել է արդեն, ապա կարմիր լույսով ազդանշան է վառվելու, և հանձնաժողովի նախագահը պարտավոր է ոստիկանություն կանչել՝ քաղաքացուն տեղամասից հեռացնելու և համապատասխան գործողություններ կատարելու համար:

Ես կարծում եմ՝ մենք պետք է նկատի ունենանք, որ էլեկտրոնային ցուցակներով մասնակցելու իրավունքից զրկված են լինելու բոլոր զինծառայողները, քրեակատարողական հիմնարկներում ընտրելու իրավունք ունեցողները, բուժհաստատություններում ստացիոնար բուժման մեջ գտնվողները, այսինքն՝ մի լուրջ կոնտինգենտ:

Այս պարագայում մենք կարող ենք ասել, որ ամբողջական չի դառնում էլեկտրոնային քվեարկության գաղափարը: Իսկ եթե սրան գումարենք, որ առաջարկվող օրենսգրքում ընդգրկվում է դրույթ, որով էլեկտրոնային սարքի փչանալու դեպքում այն չի փոխարինվելու, այլ անցում է կատարվելու ընդհանուր հիմունքներով քվեարկության, ապա պարզ կդառնա, որ սա շռայլություն է Ընտրական օրենսգրքի հանդեպ կամ էքսպերիմենտ՝ պարզելու դրա արդյունավետությունը»: Իսկ Վենետիկի հանձնաժողովը, պարոն Նորիկյանի խոսքով, «ծայրագույն պատրիարքություն» չէ, որ նստած լինի այս կամ այն պետության գլխին: Փաստաբանն ընդգծում է, որ հանձնաժողովը միայն մասնագիտական խորհրդատվություն է տրամադրում:
