Խնամատարության ուժեղացումը կպաշտպանի երեխաներին

Գործադիրն իր ս.թ. մարտի 10-ի նիստում հավանություն է տվել կյանքի դժվարին պայմաններում հայտնված երեխային խնամատարության հանձնելու ընթացակարգի բարեփոխման հայեցակարգին: Խոսքը վերաբերում է երկրում խնամատար ընտանիքների ձևավորման գործընթացին, որն առաջին հերթին դիտվելու է որպես այն երեխաների խնամքի և դաստիարակության կազմակերպման այլընտրանքային ձև, ովքեր, գտնվելով խնամքի տարբեր հաստատություններում, չունեն կենսաբանական (հարազատ) ընտանիք կամ տարբեր պատճառներով հնարավոր չէ նրանց վերադարձնել ընտանիք, կամ անհնար է նրանց խնամքը կազմակերպել ազգականների ընտանիքում:
Խնամատար ընտանիքի նոր տեսակների ներդրումը համահունչ է ինչպես տվյալ ոլորտում Հայաստանի կառավարության որդեգրած քաղաքականությանը, այնպես էլ նրա վավերացրած միջազգային մի շարք պայմանագրերի: Խնամատարության ուժեղացման անհրաժեշտությունն են վկայում նաև երեխաների պաշտպանության ոլորտում իրականացված ուսումնասիրություններն ու հետազոտությունները: Ընտանեկան միջավայրում երեխայի խնամքի և դաստիարակության առավելությունը որևէ կասկած չի հարուցում և հաստատվել է Մարդու իրավունքների եվրոպական դատարանի նախադեպային որոշումներով, ինչպես նաև գործնական փորձով: Կառավարությունը խնամատար ընտանիքի մոդելի ներդրման որոշում է ընդունել դեռ 2008 թվականի հունիսին:
Խնամատար ընտանիքն առանց ծնողական խնամքի մնացած երեխայի խնամքն ու դաստիարակությունը կազմակերպելու ձևերից է, որն իրականացվում է պայմանագրի հիման վրա: Պայմանագիրը կնքվում է խնամատարության և հոգաբարձության մարմնի և այդ նպատակով հատուկ պատրաստված խնամատար ծնողների կամ առանձին քաղաքացիների միջև` մինչև երեխայի 18 տարեկան դառնալը: Պայմանագիր կարող է կնքվել ինչպես երեխայի համար կողմնակի համարվող անձի, այնպես էլ նրա ազգականի հետ` եթե վերջինս բավարար միջոց չունի ամբողջովին ստանձնելու երեխայի խնամքի բոլոր ծախսերը:
Ակնկալվում է, որ որոշման իրականացմամբ ՀՀ ընտանեկան օրենսդրությունը կհամապատասխանեցվի միջազգային չափանիշներին: Դրա շնորհիվ կապահովվեն կյանքի դժվարին իրավիճակում հայտնված երեխայի իրավունքները, արդյունավետ պայքար կմղվի երեխայի իրավունքների խախտման դեմ, կհստակեցվեն խնամատար ընտանիքի դերն ու նշանակությունը, կսահմանվեն խնամատար ընտանիքի տեսակները և այլն:
Որոշման նախագիծը մշակել է ՀՀ աշխատանքի և սոցիալական հարցերի նախարարությունը` «Սեյվ դը չիլդրըն ինթերնեշնլ» կազմակերպության Հայաստանի ներկայացուցչության մասնակցությամբ: Փաստաթուղթը քննարկվել է շահագրգիռ պետական, տեղական ինքնակառավարման մարմինների և հասարակական կազմակերպությունների հետ: Վարչապետ Հովիկ Աբրահամյանը կարևորել է փաստաթուղթը` այն բնութագրելով «ճիշտ և արդար» որոշում:
