ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործով տվյալներ են ձեռք բերվել այն մասին, որ ՀՀ ոստիկանության Շենգավիթի բաժնի աշխատակիցը, մշտապես իրականացնելով իշխանության ներկայացուցչի լիազորություններ, 2015 թվականի մարտի 3-ին հիշյալ բաժնում քննվող քրեական գործով կողոպուտ կատարելու մեջ մեղադրվող Ա. Գ.-ի բնակարանում խուզարկություն կատարելու ընթացքում դիտավորությամբ կատարել է իր լիազորությունների շրջանակներից ակնհայտորեն դուրս եկող գործողություններ: Այն է՝ արհեստական ապացույց ստեղծելու նպատակով՝ խուզարկության ընթացքում բաճկոնից հանել և փորձել է սեղանին աննկատ դնել իր հետ բերված իրը ու հայտնել, որ այն հայտնաբերվել է խուզարկությամբ՝ բնակարանից:

Այս մասին հաղորդում է Հատուկ քննչական ծառայությունը, որը քննվող քրեական գործի նյութերով պաշտոնատար անձի կողմից պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է նոր քրեական գործ:
Ավելի վաղ ՀՔԾ–ն հայտնել էր, որ անհայտ անձը, ուրիշի գույքը բացահայտ հափշտակելու դիտավորությամբ, 2015 թվականի հունվարի 27-ին՝ ժամը 19:00-ի սահմաններում, Երևանի Չեխովի փողոցում փակելով քաղաքացի Մարիամ Ա.-ի բերանը, վերջինիս ձեռքից բացահայտ հափշտակել է զգալի չափերի «Սամսունգ Գալաքսի Գրանդ 2» մոդելի բջջային հեռախոսը և դիմել փախուստի:
Դեպքի առթիվ ՀՀ քննչական կոմիտեի Շենգավիթ վարչական շրջանի քննչական բաժնում ՀՀ քրեական օրենսգրքի 176-րդ հոդվածի 1-ին մասով հարուցվել էր քրեական գործ և ամիսներ շարունակ կատարվել նախաքննություն:
Օպերատիվ-հետախուզական և քննչական գործողությունների արդյունքում պարզվել էր նաև, որ հանցագործությունը կատարել է քաղաքացի Ա. Ա.-ն: Վերջինս, սակայն, նախաքննական մարմնին հայտնել է, որ դեպքի օրը` նույն ժամանակահատվածում, ինքը գտնվել է ընկերոջ տարեդարձին և կատարված հանցագործության դեպքի հետ որևէ առնչություն չունի:
Այնուհետև գործի փաստական հանգամանքներով պայմանավորված՝ լրիվ, օբյեկտիվ և բազմակողմանի քննությունը երաշխավորելու անհրաժեշտությունից ելնելով՝ քրեական գործը քննության է ուղարկվել ՀՀ հատուկ քննչական ծառայություն:
