Հայկական կողմը կդիմի ՄԻԵԴ, եթե Թուրքիան ձգձգի Սիսի կաթողիկոսարանի վերադարձի գործի քննությունը

Սիսի պատմական կաթողիկոսարանի վերադարձի պահանջով Թուրքիայի Սահմանադրական դատարան Մեծի Տանն Կիլիկիո կաթողիկոսության ներկայացրած հայցի քննությունը հետաձգվում է: 2016 թվականի մարտի 1-ին կաթողիկոսարանի փաստաբանը Թուրքիայի ՍԴ-ին հուշագիր է հղել` պահանջելով դատական ունկնդրության նիստ: Սակայն թուրքական դատարանի լռության ֆոնին` Արամ Ա-ի առաջարկով ու նախագահությամբ` մարտի 5-ին Ժնևում կայացել է կաթողկոսության դատական հայցի իրավական խմբի հանդիպումը, որի հիմնական նպատակն է Թուրքիայի Սահմանադրական դատարանում նշյալ հարցի գործընթացն արագացնող հանգամանքների քննարկումը: Ինչպես «Արմենպրես»-ը տեղեկացավ Cilicia TV-ի ֆեսբուքյան էջի գրառումից, մյուս կողմից` խումբը հստակեցրել է Եվրոպայի մարդու իրավունքների դատարան դիմելու հնարավորությունները` հաշվի առնելով Թուրքիայի Սահմանադրական դատարանի կողմից որդեգրվելիք հավանական դիրքորոշումը:
Թուրքիայի ՍԴ-ի կողմից հայկական դատի քննարկումն արագացնելու նպատակով խումբը լսել է թուրք փաստաբանների ու երկու այլ մասնագետների: Պարզվել է, որ ներկայում Թուրքիայի ՍԴ սեղանին մեծ թվով գործեր կան` դեռևս 2012 թվականից: Այդ փաստից ելնելով` Թուրքիայի դատարանը իրավունք ունի իր հայեցողությամբ հաստատել գործերի քննության առաջնահերթություն: Հաշվի առնելով Սիսի կաթողիկոսարանի վերադարձի պահանջի քաղաքական բնույթը` Սահմանադրական դատարանը հնարավոր է այն «ոչ առաջնահերթ» դիտարկի ու ձգձգի գործի քննությունը:
Կաթողիկոսարանի դատի իրավական խումբը որոշել է շարունակել Մեծի Տանն Կիլիկիո կաթողիկոսության կողմից լիազորված փաստաբանի միջոցով Թուրքիայի Սահմանադրական դատարանին հիշեցման հուշագրեր ներկայացնել: Եթե Սահմանադրական դատարանը լռություն պահպանի ու հետաձգի հարցի քննարկումը, «տրամաբանական ժամանակ» սպասելուց հետո հայկական կողմը կարող է դիմել ՄԻԵԴ-ին, որի կանոնադրության 6-րդ հոդվածը թույլ է տալիս որևէ դատական գործի համար հատկացված «տրամաբանական ժամանակ»-ի խախտման դեպքում դիմել իրենց:
Դրան զուգահեռ որոշվել է պատրաստել ՄԻԵԴ-ին դիմելու թղթածրար` Թուրքիայի ՍԴ-ի վերջնական հավանական որոշումն ու մոտեցումները հաշվի առնելով:
Հանձնախումբը նաև անգլերենով պատրաստել է հաղորդագրություն հանդիպման մասին` հիշեցնելով, որ 2015 թվականի ապրիլի 27-ին Մեծ Տանն Կիլիկիո կաթողիկոս Արամ Առաջինը դիմել է Թուրքիայի Սահմանադրական դատարան իրեն պատկանող Սիսի կաթողիկոսարանի սեփականության իրավունքի վերահաստատման պահանջով: Միջազգային օրենքի ու Լոզանի պայմանագրի համաձայն`Թուրքիայի կառավարությունը պարտավոր է կաթողիկոսարանի կալվածքը վերադարձնել, որպեսզի այն գործածվի կրոնական պաշտամունքի նպատակով:
Եթե Թուրքիայի կառավարությունը կամովին չվերադարձնի Սիսի կաթողիկոսարանը կամ Թուրքիայի ՍԴ-ն որոշի չվերադարձնել այն, այս հարցով Մեծի Տանն Կիլիկիո կաթողիկոսը դատական հայց կներկայացնի Մարդու իրավունքների եվրոպական դատարան:
