Ներկայացված Ընտրական օրենսգրքի նախագծի մի շարք առանցքային կարգավորումներ անհամատեղելի են ժողովրդավարական արժեքներին: Այս կարծիքին է իրավաբան, փաստաբան Տիգրան Սարգսյանը:

Past.am-ի հետ զրույցում նա ներկայացրեց մի քանի հիմնավորում. «Նախագծի համաձայն՝ Հայաստանի Հանրապետությունում գրանցված հասարակական կազմակերպությունները դիտորդական առաքելություն կարող են իրականացնել բացառապես հրավերի առկայության դեպքում, իսկ գործող օրենսգիրքը հնարավորություն է տալիս հասարակական կազմակերպություններին առանց հրավերի և համապատասխան ընթացակարգեր անցնելուց հետո գրանցվել Կենտրոնական ընտրական հանձնաժողովում, իրականացնել դիտորդական առաքելություն: Նոր նախագծով դիտորդական առաքելության իրականացման իրավունքից զրկվել են Հայաստանի Հանրապետությունում հավատարմագրված դիվանագիտական և հյուպատոսական ներկայացուցչությունները, ինչը, բնականաբար, մեծացնելու է ընտրական գործընթացներում ստվերային խարդավանքների հնարավորությունը»։

Սարգսյանը նշեց, որ ներդրվել է ընտրական հանձնաժողովի նախագահի կողմից դիտորդին, ԶԼՄ-ի ներկայացուցչին, վստահված անձին հանձնաժողովի նիստից կամ քվեարկության սենյակից հեռացնելու ինստիտուտ, մինչդեռ գործող օրենսգրքով դիտորդը կարող է հեռացվել բացառապես ձերբակալման կամ կալանավորման դեպքում։ «Չի թույլատրվում դիտորդի կամ ԶԼՄ-ի ներկայացուցչի կողմից ստանալ ընտրական փաստաթղթերի պատճենները, քաղվածքներ կատարել քվեարկության կտրոններից, ավելին, դիտորդները և ԶԼՄ-ների ներկայացուցիչները զրկվել են քվեարկության արդյունքների վերահաշվարկի ժամանակ ընտրողների ստորագրած ցուցակներից քաղվածքներ կատարելու իրավունքից»,- շեշտեց Տիգրան Սարգսյանը։

Մեր զրուցակիցը հավելեց նաև, որ նախագծով Ազգային ժողովի ընտրությունների ժամանակ թույլատրելի է համարվում քվեաթերթիկում ցանկացած տիպի նշում անելը: Ըստ իրավաբանի՝ նման կարգավորումը նպատակ է հետապնդում ստեղծել ընտրական կաշառքի համար բարենպաստ պայմաններ:
