ՀՀ Արդարադատության նախարարության Անձնական տվյալների պաշտպանության գործակալությունը մշակել է տեսահսկման հիմնական կանոններն ու սկզբունքներն ընդգրկող լայնածավալ մի ձեռնարկ՝ «Տեսահսկման ուղեցույց», որով պետք է առաջնորդվեն հանրային վայրերում տեսահսկում իրականացնող կազմակերպությունները:

Ըստ ուղեցույցի՝ հասարակական վայրում տեսահսկում կարող է իրականացվել մի քանի նպատակներով՝ անվտանգության ապահովման, հանցագործությունները կանխելու, անձանց անվտանգության եւ գույքի պաշտպանության, հասարակական կարգի պահպանության եւ անչափահասների վրա վնասակար ազդեցությունը կանխելու, ինչպես նաեւ գաղտնի տեղեկատվությունը պաշտպանելու նպատակով:

Ըստ ուղեցույցի՝ տեսահսկումն արգելվում է հասարակական վայրերի հանդերձարաններում, սանհանգույցներում, հանգստի սենյակներում, լողասենյակներում եւ մասնավոր պահարաններում:

Ուղեցույցի կարեւոր սկզբունքներից մեկն էլ այն է, որ տեսահսկողը պարտավոր է տեսանելի վայրում նախազգուշացնող նշան ունենալ:

Ըստ այս ձեռնարկի՝ շենքերի ներսում, աշխատավայրում, կարելի է տեսահսկման համակարգ տեղադրել, եթե միայն դա անհրաժեշտ է անձանց անվտանգությունը եւ գույքը վնասներից պաշտպանելու, գաղտնի տեղեկատվությունը պաշտպանելու նպատակով:

Բազմաբնակարան շենքերի դեպքում՝ տեսախցիկներ տեղադրելուց առաջ բոլոր բնակիչները պետք է տեղյակ լինեն տեսահսկման մասին, ինչպես նաեւ պետք է առկա լինի բազմաբնակարան շենքի սեփականատերերի առնվազն կեսից ավելիի գրավոր համաձայնությունը: Ինչպես հետեւում է այս ուղեցույցից՝ բնակելի շենքերում տեսահսկման վերաբերյալ նախազգուշացումը պետք է տեսանելի լինի շենք մտնող յուրաքանչյուր անձի համար:

Նշենք, որ վերոնշյալ սկզբունքերը, որոնք կարգավորված են «Անձնական տվյալների պաշտպանության մասին» ՀՀ օրենքով, խախտելու համար սահմանված է վարչական պատասխանատվություն՝ տուգանքի ձեւով, որի չափը տատանվում է 50 հազար դրամից մինչեւ 500 հազար դրամ:

Անձնական տվյալների պաշտպանության գործակալության պետ Շուշան Դոյդոյանն իր հարցազրույցներից մեկում, անդրադառնալով հանրային վայրերում տեսահակման խնդրին, ասել էր, որ հանրային վայրերում տեսահսկումը, որը լայնորեն կիրառվում է թե՛ մասնավոր, թե՛ պետական սեկտորի կողմից, օրենքով ամենեւին կարգավորված չէ:

«Միայն ՃՈ-ի կողմից իրականացվող տեսահսկումն է, որ օրենքով կարգավորվում է: Միջազգային լավագույն փորձը կկիրառենք մեզ մոտ, կառաջարկենք կարգավորումներ»,-նշել է նա: Դոյդոյանն այդ ժամանակ նշել էր, որ պատրաստվում է տեսահսկման ուղեցույց, որով պետք է առաջնորդվեն բոլորը:
